【摘要】：“能源”一词自诞生以来,便已影响人们的生活,关系国家的存亡与发展。特别是人类社会开启工业革命后,对能源的需求更是与日俱增,可以这样说,如果没有能源或是能源供应中断,人类社会便会陷入混乱,直至灭亡。在人类当下能源利用结构中,尽管可再生能源、清洁能源等能源所占比重正逐步提高,但是化石能源几乎不可代替,特别是石油,维持着地球上人类生活、经济发展与社会进步,重要性不言而喻。然而,在地球上,能源储量毕竟有限,且能源分布不均,受国内国际局势影响,能源安全问题便时常影响国家的稳定和发展。能源安全关系国计民生,是国家法律政策的重中之重。然而,我国能源安全法律制度极不完善,能源法律体系尚未建立,能源法律制度不完整,不能有效的保障我国的能源安全。因此,本文从能源安全概念及其相关问题研究入手,分析我国能源安全法律制度的现状,再通过借鉴国外主要发达国家的能源安全立法经验,探讨建立健全能源安全法律体系,完善能源安全法律制度。文章分为五个部分,第一部分,论述能源安全及其相关问题,旨在阐述保障能源安全的必要性；第二部分,论述我国能源安全法律制度的现状；第三部分,论述我国能源安全法律制度的缺陷；第四部分,阐述主要发达国家能源安全能源安全法律制度及其对我国的启示；第五部分,论述如何完善我国能源安全法律制度。
[Abstract]:Since its birth, the term "energy" has affected people's lives and has a bearing on the survival and development of our country. In particular, since the industrial revolution began in human society, the demand for energy has increased. If there is no energy or if the energy supply is interrupted, the human society will fall into chaos until its demise. In the current energy use structure of mankind, although the share of renewable energy, clean energy and other energy sources is gradually increasing, But fossil energy is almost irreplaceable, especially oil, which sustains human life, economic development and social progress on the planet. However, on Earth, energy reserves are limited and energy distribution is uneven. Under the influence of the domestic and international situation, energy security issues often affect the stability and development of the country. Energy security relates to the national economy and the people's livelihood, which is the top priority of the national legal policy. However, the legal system of energy security in our country is extremely imperfect. The legal system of energy has not yet been established, and the legal system of energy is incomplete, which can not effectively guarantee the energy security of our country. Therefore, this paper begins with the research of the concept of energy security and its related problems, and analyzes the present situation of the legal system of energy security in China. Then, by drawing lessons from the experience of the major developed countries in foreign countries on energy security legislation, this paper discusses the establishment of a sound legal system for energy security and the perfection of the legal system of energy security. The article is divided into five parts. The first part discusses energy security and its related problems. The second part discusses the current situation of our country's energy security legal system; the third part, discusses the defects of our country's energy security legal system; the 4th part, This paper expounds the legal system of energy security in major developed countries and its enlightenment to China. Part 5th discusses how to perfect the legal system of energy security in China.
