【摘要】：从1942年世界上第一座核反应堆诞生以来,核能大规模的发电成为一种技术奇迹,核能发电为世界的电力供应做出了重要贡献,成为核能民用领域的重要组成部分。国际原子能机构(以下简称IAEA)以促进核能民用,限制核能军用为宗旨,对核能民用的各环节进行监督与管制,建立了一套系统完备的法律制度,为核能民用提供的法制保障,因此,在保证核电不断发展的同时,更加需要对核电厂进行监管,对核电厂使用核材料进行监督和管制,防止核能军用。本文旨在通过对IAEA核能民用法律基本制度的分析,总结出涉及核电厂建设、运营、退役、应急及监管法律制度,形成IAEA法律框架中的核电厂法律制度,实现对核电厂从选址到运营退役等各方面法律监管,确保核电厂运营安全,为核电厂提供良好的法制环境。
[Abstract]:Since the birth of the world's first nuclear reactor in 1942, large-scale nuclear power generation has become a technological miracle, and nuclear power generation has made an important contribution to the world's electricity supply. The International Atomic Energy Agency (IAEAA), with the aim of promoting the civil use of nuclear energy and limiting the use of nuclear energy for military purposes, supervises and controls all aspects of the civil use of nuclear energy. A systematic and complete legal system has been established to provide legal safeguards for the civilian use of nuclear energy. Thus, while ensuring the continuous development of nuclear power, there is an even greater need to regulate nuclear power plants and to monitor and control the use of nuclear materials in nuclear power plants, The purpose of this paper is to summarize the legal system concerning the construction, operation, decommissioning, emergency and supervision of nuclear power plants, and to form the legal system of nuclear power plants in the legal framework of IAEA. In order to ensure the safety of the nuclear power plant operation and provide a good legal environment for the nuclear power plant, the legal supervision of the nuclear power plant from site selection to operational decommissioning is realized.
