【摘要】： 随着环境污染和生态破坏问题的日益严重,生态安全日益成为影响国家安全的重要问题。作为一种新型的国家安全,生态安全反映出一种全新的国家安全理念。它是国家安全的根本,其他安全都建立在生态安全的基础之上。我国社会正在转型,国家生态安全面临着一系列严峻挑战。生态安全问题关系到经济和社会的可持续发展能否实现。深入研究我国的生态安全问题具有十分迫切的要求和深远的意义。目前,在世界范围内,关于生态安全问题的研究,总体上处于起步阶段。笔者相信,对这一课题的研究可以更好地构建我国的生态安全法律保障制度体系,客观上也许有助于推动环境资源法学研究向更高层次发展。论文首先厘清了生态安全的概念、本质、特点、分类、重要性及理论与现实意义。然后,从政治学、经济学、伦理学视角,分析了重视和维护国家生态安全的理论价值。其后,又对俄罗斯、美国、日本的生态安全法律保障制度进行了研究,以期为我国的法律保障制度构建提供更多的可资借鉴的经验。之后,论文指出了我国生态安全的现状及形成该现状的原因,并在分析我国生态安全法治建设现状及不足的基础上,提出了完善我国生态安全法律保障制度的一些构想。
[Abstract]:With the increasingly serious problems of environmental pollution and ecological destruction, ecological security has become an important issue affecting national security. As a new type of national security, Ecological security reflects a new concept of national security, which is the foundation of national security, and other security is based on ecological security. Our society is undergoing transformation. National ecological security is facing a series of severe challenges. Ecological security is related to the realization of sustainable development of economy and society. At present, the research on ecological security is in its infancy in the world. The author believes that the research on this subject can better construct the legal system of ecological security in our country. Objectively, it may help to promote the development of environmental and resource law research to a higher level. The paper first clarifies the concept, essence, characteristics, classification, importance and theoretical and practical significance of ecological security. Then, from the perspective of politics, economics and ethics, The theoretical value of attaching importance to and maintaining national ecological security is analyzed. After that, the legal protection system of ecological security in Russia, the United States and Japan is also studied. After that, the paper points out the current situation of ecological security in China and the reasons for its formation. On the basis of analyzing the present situation and deficiency of the legal construction of ecological security in our country, this paper puts forward some ideas to perfect the legal guarantee system of ecological security in our country.
