【摘要】：日本是一个灾害频发的国家,特别重视灾害应急处理,有着完善的灾难应急法律制度。福岛事故前,曾作为核能大国的日本,其核应急法制建设方面也较为完备。然而,福岛核事故的发生打破了日本的“不败神话”。但并不能对日本核应急法律制度作全盘否定。这只能说明日本核应急法律制度还存在不足。并且在世界三大核事故中,日本福岛核事故是距今最近的。其事故发生、应急处理等方面,都包含时代性的技术、法律、管理等问题。因此,研究日本核应急法律制度更具有时代的意义和借鉴的价值。本文以日本具体的核应急法典为基础,结合大量的国际条约、各国法规以及学术专著等,通过五部分的论述,辩证分析日本核应急法律制度的特点与问题,并结合中国核应急法律制度现状,提出相应建议。第一部分:主要通过分析总结涉及核应急的相关立法规定和理论研究,概括出核应急的具体含义和范围。并结合核应急的含义,得出核应急法律制度的内涵。而后着重介绍了日本核应急立法概况。根据核应急范围和日本核应急法律内容设置概况,将日本核应急法律制度分为三大制度,即核应急准备制度、核应急响应制度与核应急恢复制度。第二部分至第四部分就三大应急制度分别作了详细介绍,总结分析各应急制度的特点,并结合福岛核事故中出现的问题,指出各应急制度存在的不足。最后,介绍了日本针对福岛事故应急中的问题,所做出的相应改革。第五部分:介绍了中国核应急法律制度的现状,并辩证评析该制度。最后,借鉴日本核应急法律制度的特点与问题,提出了相关完善建议。
[Abstract]:Japan is a disaster prone country, pay special attention to disaster emergency treatment, a disaster emergency legal system perfect. Before the Fukushima accident, served as a nuclear power in Japan, the construction of nuclear emergency legal system is relatively complete. However, the Fukushima nuclear accident broke the "myth". But can not be completely negative for Japan's nuclear emergency legal system. This only shows that Japan's nuclear emergency legal system is still inadequate.
