污染土壤修复基金法律制度研究

【摘要】：污染土壤修复基金能够为污染土壤修复的顺利开展提供充足的资金保障,已成为世界范围内诸多国家（地区）解决污染土壤修复资金短缺问题的普遍选择。目前,我国污染土壤修复处于初始阶段,我国并没有构建污染土壤修复基金法律制度。所以,为实现我国土壤资源的可持续发展,我国应构建污染土壤修复基金法律制度。本文主要对污染土壤修复基金法律制度构建的理论依据进行简要分析,介绍域外污染土壤修复基金法律制度的先进经验,立足于我国国情,为我国的污染土壤修复基金法律制度构建提出建议,以促进我国土壤资源的可持续发展。本文主要分为四部分:第一部分主要是对污染土壤修复基金法律制度的概述。首先,介绍土壤污染的概念与特点,主要包括土壤污染隐蔽性、滞后性、积累性和不可逆性的特点;其次,介绍污染土壤修复基金的界定;最后,分析构建我国污染土壤修复基金法律制度的理论基础,包括可持续发展理论、生态平衡理论以及循环经济理论。第二部分主要是对域外污染土壤修复基金法制度的介绍和评析,其先进经验为我国污染土壤修复基金法律制度构建提供有益借鉴。该部分通过对美国、德国和我国台湾地区的污染土壤修复基金法律制度的研究,得出上述国家和地区在污染土壤修复基金法律制度方面的可取之处:完善的污染土壤修复基金立法体系、基金的筹集渠道多元化、基金的适用条件明确、基金的管理体系健全。第三部分主要是介绍建构我国污染土壤修复基金法律制度的必要性。首先,介绍我国污染土壤修复面临的挑战,包括土壤污染的危害、污染土壤修复难度大、周期长、所需成本高等问题;其次,指出了我国污染土壤修复资金保障缺失问题,包含我国污染土壤修复资金保障立法缺失、来源单一且匮乏、追责体系不完善,从而分析我国构建污染土壤修复基金法律制度的必要性。第四部分主要是对构建我国污染土壤修复基金法律制度提出的建议,以促进我国土壤资源可持续发展。在汲取域外污染土壤修复基金法律制度优秀元素并结合我国现存问题的基础上,提出了建立污染土壤修复基金法律体系、设立多元化的污染土壤修复基金来源、明确污染土壤修复基金的启动条件及支付范围、建立完善的污染土壤修复基金管理体系四方面的建议,以构建我国污染土壤修复基金法律制度。
[Abstract]:Pollution soil remediation fund can provide sufficient financial guarantee for the smooth development of contaminated soil remediation. It has become a common choice for many countries (regions) around the world to solve the problem of shortage of funds for remediation of contaminated soil. At present, The remediation of contaminated soil in China is in the initial stage, and there is no legal system of fund for the remediation of contaminated soil in China. Therefore, in order to realize the sustainable development of soil resources in China, In this paper, the theoretical basis for the construction of the legal system of the contaminated soil remediation fund is briefly analyzed, and the advanced experience of the legal system of the pollution soil remediation fund outside the country is introduced. Based on the situation of our country, this paper puts forward some suggestions for the construction of the legal system of the pollution soil remediation fund in our country. In order to promote the sustainable development of soil resources in China, this paper is mainly divided into four parts: the first part is an overview of the legal system of soil remediation fund. First, the concept and characteristics of soil pollution are introduced. It mainly includes the characteristics of soil pollution concealment, lag, accumulation and irreversibility. Secondly, the definition of pollution soil remediation fund is introduced. Finally, the theoretical basis of constructing the legal system of pollution soil remediation fund in China is analyzed. It includes sustainable development theory, ecological balance theory and circular economy theory. Its advanced experience provides a useful reference for the construction of the legal system of the pollution soil remediation fund in China, which is based on the study of the legal system of the pollution soil remediation fund in the United States, Germany and Taiwan. The advantages of the above countries and regions in the legal system of the pollution soil remediation fund are as follows: perfect legislative system of the contaminated soil remediation fund, diversification of the funding channels, clear conditions for the application of the fund, The third part mainly introduces the necessity of constructing the legal system of soil remediation fund in China. Firstly, it introduces the challenges faced by the remediation of contaminated soil in China, including the harm of soil pollution. Pollution soil remediation is difficult, long period and high cost. Secondly, it points out the lack of fund guarantee for contaminated soil remediation in China, including the lack of legislation of pollution soil remediation fund, the source of which is single and scarce. The author analyzes the necessity of constructing the legal system of the pollution soil remediation fund in China. The fourth part is mainly about the suggestion of constructing the legal system of the pollution soil remediation fund in China. In order to promote the sustainable development of soil resources in China, a legal system of soil remediation fund for polluted soil is put forward on the basis of absorbing the excellent elements of the legal system of the Fund for the remediation of contaminated soil outside China and combining with the existing problems in our country. It is necessary to set up a diversified fund for the remediation of contaminated soil, define the starting conditions and payment scope of the fund, and establish a sound management system of the fund for the remediation of contaminated soil.
