【摘要】：面对日益严峻的环境压力,人们纷纷对传统的经济增长方式和经济发展理论进行反思,从单纯的追求经济的增长扩大到经济的循环发展,追求人与社会的和谐发展。20世纪90年代以来,许多发达国家都将发展循环经济、建立循环型社会作为实现保护环境和实现经济协调发展的一个重要途径。党和国家也意识到了这一点,明确提出了发展循环经济是加快建设资源节约型和环境友好型社会的重要手段之一。生产者责任延伸制度是发展循环经济的一项重要保障措施,能起到保驾护航的作用,生产者责任延伸制度是将生产者的责任延伸到整个产品的生命周期,特别是强调产品设计和产品回收、循环利用等产品消耗之后的责任,并强调政府、销售者和群众也应该承担起自己应有的责任。2008年8月29日通过,并于2009年1月1日施行的《循环经济促进法》更加明确了生产者责任延伸制度。本文通过对循环经济促进法的基本理论问题进行研究,从循环经济的概念、特征、理论来源和责任主体等部分进行阐述,并借鉴国外先进的经验,侧重结合我国于2009年1月1日施行的《循环经济促进法》对生产者责任延伸制度的规定来对生产者责任研究制度进行进一步的研究,以期促进生产者责任延伸制度的完善和更好的实施,促进经济的循环发展,促进人与社会的和谐发展。本文共分为四章,具体如下：第一章是循环经济促进法生产者责任延伸制度的理论基本理论问题,第一节为循环经济促进法生产者责任延伸制度的概念,第二节为循环经济促进法生产者责任延伸制度的相关理论问题。笔者通过介绍不同国家、地区以及我国学者对生产者责任延伸制度的定义,进一步梳理了笔者对循环经济促进法生产者责任延伸制度的理解。同时,本章还对循环经济促进法的生产者责任延伸制度其他相关基本理论问题进行了介绍,通过生产者责任延伸制度的概念、特征、责任主体、价值取向和作用、理论基础等进行阐述,以期对循环经济促进法的生产者责任延伸制度有更加深刻的理解,并为后面的论断提供理论依据。第二章是国外循环经济促进法的生产者责任延伸制度以及启示。本章主要介绍了瑞典、德国等欧盟国家、美国、日本等国家生产者责任延伸制度的立法和具体的实践操作,并总结出对我国建立和完善循环经济促进法生产者责任延伸制度的启示。第三章是我国循环经济促进法的生产者责任延伸制度的相关规定及存在的问题分析。本章通过对我国循环经济促进法生产者责任延伸制度的具体规定,并结合在实践中存在的问题,提出了我国循环经济促进法生产者责任延伸制度存在的问题。第四章是完善我国循环经济促进法生产者责任延伸制度的基本构想。这一部分,主要从明确相关责任主体的合理定位、激励措施、信息责任、公众参与以及其他相配套的措施等方面进行构想。
