电子废物管理的法律制度研究

【摘要】： 随着电子产品更新速度的加快,电子废物的数量迅速增加,影响也越来越大。一方面,电子废物已经成为了一个重大的污染源。电子废物中含有多种有害物质,如果不对其进行妥善处理,将会严重的影响环境的质量和人类的身体健康。另一方面,电子废物的资源性特征能使其转变为巨大的资源宝库,这将有效解决我国能源供需不足的矛盾。电子废物问题目前已经得到国际社会的广泛关注,许多国家已积极行动起来,制定了大量的法律文件,并取得了显著的成效。我国制定了一些关于电子废物管理的法规和规章,但仍然存在不足。本文旨在通过对电子废物管理法律制度的基本问题分析,从电子废物管理法律制度构建的理论基础出发,结合环境法领域的基本原则,并在参考国外的立法状况和发展动态的基础上,提出适合我国国情的专门的电子废物管理法律制度构建的具体设想,以期望为推动电子废物管理的法律制度的构建做出一些有益的探索。
[Abstract]:Electronic waste has become a major source of pollution . In one aspect , electronic waste has become a major source of pollution . On the other hand , the resource character of the electronic waste can transform it into a huge resource treasury , which will effectively solve the contradiction of insufficient energy supply and demand in our country .

Electronic waste management has been widely paid attention to by the international community . Many countries have taken positive actions to develop a large number of legal documents and have achieved remarkable results . In the light of the basic problems of the legal system of e - waste management , the paper puts forward some specific ideas for the construction of the legal system of e - waste management , which is suitable for the national conditions of our country , based on the theoretical foundation of the legal system of e - waste management , and puts forward some useful exploration for the construction of the legal system for the management of e - waste .
