油污单位责任限制法律制度的必要性和可行性研究

【摘要】:目前,海上石油运输已经成为航运业非常重要的部分,它在推动世界航运市场发展的同时,也给环境和生态等造成了一定的影响。船舶溢油事故发生以后,随之而来的是一系列的民事赔偿案件,而调整这类民事赔偿案件的国际公约和协定也在跟随市场和经济变化进行着不断地修正。 本文通过分析一系列的国内和国际船舶碰撞案例,提出了建立海上船舶油污事故民事赔偿的新制度即单位赔偿责任限制制度,论证了该制度建立的可行性、必要性以及具体的操作程序,对建立该制度应考虑的问题进行探究,在此基础上分析了该制度与其他相关制度的关系。文章从理论和适用性等方面对油污单位赔偿责任限制制度建立的必要性和可行性进行了论证,运用了图表举例,数据对比等多种方法进行分析,搜集了大量的资料,并就如何建立“油污单位赔偿责任限制制度”提出了自己的见解,但本文只是进行了初步的分析论证,希望本文能够引起相关专家、实务工作者等的注意,对油污单位责任限制赔偿体系进行详细的论证,以推动相关立法的发展。 本文中所提到的“油污单位责任限制赔偿体系”与货物运输损害赔偿中的“单位责任限制”是不同的,不可以一概而论,本文所提到的赔偿体系和《国际油污损害民事责任公约》是一种逻辑上的互补关系,二者互相完善。论文在最后的部分,结合目前的油污赔偿机制进行分析,提出了初步的油污单位责任限制赔偿体系的立法建议,指出建立这种赔偿体系可以在很大程度上解决目前我国油污保险机制、赔偿机制所存在的处理困境,它无疑能够进一步解决实践中民事索赔问题,弥补《国际油污损害民事责任公约》的不足之处,节省诉讼资源,简化诉讼程序,促进整个航运市场的发展。
[Abstract]:At present, the marine oil transportation has become a very important part of the shipping industry. It not only promotes the development of the world shipping market, but also has a certain impact on the environment and ecology.After the oil spill accident, a series of civil compensation cases followed, and the international conventions and agreements to adjust this kind of civil compensation cases are constantly amended with the market and economic changes.Based on the analysis of a series of domestic and international ship collision cases, this paper puts forward a new system of civil compensation for oil pollution accidents of ships at sea, that is, the limitation system of unit liability, and proves the feasibility of the establishment of the system.The necessity and the concrete operation procedure are discussed, and the relationship between the system and other related systems is analyzed on the basis of analyzing the problems that should be considered in the establishment of the system.In this paper, the necessity and feasibility of establishing the limitation system of compensation liability of oil pollution units are demonstrated from the aspects of theory and applicability. A lot of data are collected and analyzed by using many methods, such as chart and example, data contrast and so on.The author also puts forward his own opinion on how to set up the "limitation system of compensation liability of oil pollution units", but this paper only makes a preliminary analysis and demonstration, hoping that this paper can arouse the attention of relevant experts, practitioners and so on.The liability limitation compensation system of oil pollution unit is demonstrated in detail to promote the development of relevant legislation.The "liability limitation compensation system of oil pollution units" mentioned in this paper is different from the "unit liability limitation" in the damage compensation for the carriage of goods.The compensation system mentioned in this paper and the International Convention on Civil liability for Oil pollution damage are logical complementary relations and they are mutually perfect.In the last part of the paper, combined with the analysis of the current oil pollution compensation mechanism, the paper puts forward the preliminary legislative proposals of the liability limitation compensation system of the oil pollution unit.It is pointed out that the establishment of this compensation system can to a great extent solve the problems existing in the present oil pollution insurance mechanism and compensation mechanism in China, and it can undoubtedly further solve the problem of civil claims in practice.To make up for the deficiency of the International Convention on Civil liability for Oil pollution damage, to save the litigation resources, to simplify the litigation procedure, and to promote the development of the shipping market as a whole.
