环境侵权因果关系理论构建与实践探究

【摘要】：环境侵权现在虽然已不是一个全新的课题,但就我国法学界对该问题的研究现状来看,能深入具体地对立法和司法实践提供指导作用的理论研究还是十分欠缺的。特别是随着我国现代化进程的推进,由环境污染和破坏引发的环境侵权纠纷越来越多的情况下,国家特别需要法学研究者能够研究出解决环境侵权纠纷的具体途径与方法。由于环境侵权的特殊性,致使环境侵权因果关系的认定困难重重,运用盖然性、疫学、经验法则理论来推定因果关系,有利于保护受害人,实现法的正义价值。但是,这些学说仍然存在适用范围较窄、对法官素质要求较高以及需要判例支持等问题。我国应确定以正义、秩序和效率为主要价值目标,以相当因果关系为基础,以因果关系推定为原则,遵循较低盖然性证明标准,构建“一横一纵”式包含各种判断标准和方法在内的环境侵权因果关系认定规则体系。
[Abstract]:Although environmental tort is not a new subject now, the theoretical research that can provide guidance to the legislative and judicial practice is still very short in view of the current research situation in the law circles of China. Especially, the environmental tort caused by environmental pollution and destruction is caused by the progress of China's modernization. In the case of more and more disputes, the state especially needs the law researchers to study the specific ways and methods to solve the environmental tort disputes. Due to the particularity of environmental tort, the causality of environmental tort is difficult to be identified. The causal relationship is presumed by using the probability, the epidemic and the experience law, which is beneficial to the protection of the victims. However, these theories still have some problems such as narrow scope of application, higher requirement for judges' quality and need for case support.
Our country should determine the main value target of justice, order and efficiency, based on the considerable causality, the presumption of causality and the standard of low probability of proof, and build a system of the rule of causation of environmental tort, which includes a variety of criteria and methods of judgment, which includes various criteria and methods.
