海域使用管理法律问题研究

【摘要】： 我国海域资源丰富,有着18000多公里的海岸线,内海、领海面积辽阔。近代,特别是90年代以来,海洋开发已成为我国沿海经济发展的重要组成部分,无论是传统的海洋开发,还是新兴的产业活动都在不断的发展。与此同时,我们也可从各种途径获悉,国际国内已意识到“海洋区域的种种问题彼此密切相关,必须将其作为一个整体,实施海域综合治理,维持海洋可持续发展”。为了更好地解决海域使用管理过程中出现的法律问题,本文论述分为四章。第一章,对海域使用管理中“海域”、“海域权属制度”、“海域使用管理制度”等进行概述,以此作为全文论述基础,才能准确清楚的进一步分析在海域使用过程中可能产生的问题。同时,本章从海域定义、特征等方面做一个系统地介绍,为下文的进一步论述作铺垫。第二章,我国的《海域使用管理法》在2002年开始实施,以此来规范海域使用管理。但海洋环境质量仍在不断下降,资源仍遭受不断的破坏,于是,海洋开发利用的不断发展对我国海洋管理提出了新的任务和要求。因此,如何保障海域的可持续发展,更好地实施海域使用管理,是我国面临的主要难题。本章重点对海域使用管理的现状及问题的分析,发现海域使用管理的实践情况及立法现存的问题。主要表现在海域使用管理体制、制度不完善;另外,立法滞后于海域使用方式的发展,缺少统一的海洋执法队伍等。第三章,对《联合国海洋法公约》以及国外海域使用法律制度的介绍。在近几十年中,联合国及有关国际海洋组织认识到海域使用面临的种种问题,海洋的可持续发展的重要性,制定了《联合国海洋法公约》,作为各国海洋资源保护的一个纲领性规范。此后,许多国家根据本国情况,纷纷制定了本国的海域使用管理方面的法律法规,保障本国海洋资源开发利用过程中的秩序,也为我国海域使用管理提供了不少值得借鉴的经验。第四章,在对海域使用管理存在问题分析过后,本文从3方面提出了自己的建议:海域使用管理体制完善;海域使用管理制度完善;《海域使用管理法》的完善及法律法规的协调。希望能为海域资源的保护起到一定的作用。
[Abstract]:Our country sea area is rich in resources, has more than 18000 kilometers coastline, the inland sea, the territorial sea area is vast. In modern times, especially since the 1990s, marine development has become an important part of the coastal economic development in China, both traditional marine development and emerging industrial activities are constantly developing. At the same time, we can also learn from various ways that the international and domestic countries have realized that "the problems of the marine area are closely related to each other, and we must take them as a whole to carry out the integrated management of the sea area and maintain the sustainable development of the ocean". In order to solve the legal problems in the process of sea area management, this paper is divided into four chapters. The first chapter summarizes the "sea area", "sea area ownership system" and "sea area use management system" in the management of sea area use. In order to analyze the possible problems in the use of sea area accurately and clearly. At the same time, this chapter makes a systematic introduction from the definition and characteristics of sea area, paving the way for further discussion. The second chapter, China's Sea area use Management Law was implemented in 2002 to regulate the use of sea area management. However, the quality of marine environment is still declining and the resources are still being destroyed. Therefore, the continuous development of marine exploitation and utilization has put forward new tasks and requirements for marine management in China. Therefore, how to ensure the sustainable development of the sea area and better implement the sea area use management, is the main problem that our country faces. This chapter focuses on the analysis of the current situation and problems of sea area use management, and finds out the practice of sea area use management and the existing problems in legislation. In addition, the legislation lags behind the development of the sea area use mode, and lacks the unified marine law enforcement team and so on. The third chapter introduces the United Nations Convention on the Law of the Sea and the legal system of the use of foreign sea areas. In recent decades, the United Nations and relevant international maritime organizations have recognized the problems facing the use of the oceans and the importance of the sustainable development of the oceans, The United Nations Convention on the Law of the Sea has been formulated as a programmatic norm for the protection of marine resources. Since then, according to their national conditions, many countries have formulated their own laws and regulations on the use and management of sea areas to ensure the order in the process of exploitation and utilization of their marine resources. It also provides a lot of experience for China's sea area management. Chapter four, after analyzing the existing problems of sea area use management, this paper puts forward some suggestions from three aspects: perfecting the management system of sea area use; The management system of sea area use is perfect, the law of sea area use management and the coordination of laws and regulations. Hope to play a role in the protection of marine resources.
