《矿产资源法》修改中的“权证分开”问题研究

【摘要】：《矿产资源法》中的"权"和"证"主要是指矿业权和行政权,如何处理"权"与"证"的关系是现行《矿产资源法》修改中所面临的基础性问题。现行《矿产资源法》中"权证合一"的立法模式不仅在理论上难以自圆其说而且在实践中也存在诸多弊端。在《矿产资源法》以"权证分开"的立法模式取代现行"权证合一"模式在理论上具有充分的合理性,在具体的制度设计方面也具可行性。
[Abstract]:The "rights" and "certificates" in the Mineral Resources Law mainly refer to the mining rights and administrative powers. How to deal with the relationship between "rights" and "certificates" is the basic problem in the revision of the present Mineral Resources Law. The legislative model of "the combination of warrants and warrants" in the present Mineral Resources Law is not only difficult to justify itself in theory but also has many drawbacks in practice. In "Mineral Resources Law", it is reasonable in theory to replace the current mode of "combination of warrants and warrants" with the legislative model of "separation of warrants", and it is also feasible in the aspect of specific system design.
