【摘要】： 环境保护领域的依法行政事关群众环境权益和社会和谐稳定。人们对环境行政处罚裁量基准克服裁量随意性的功能期待,使裁量基准作为环保部门依法行政的自我改良之举迅速兴起。本文就环境行政处罚裁量基准设定的必要性与强制性、控制技术及监督制约进行了深入的分析。提出环境行政处罚裁量基准原则、相关因素的确定应作为国家、省和有立法权的市的环保部门的强制义务,裁量基准的制定应作为各级有执法权的环保部门的强制义务。通过简单的裁量基准分格技术与处罚公式和分格相结合的裁量基准分格技术的对比,分清了不同分格技术的优劣,提出了完善措施。对环境行政处罚裁量基准的司法监督、行政内部监督、公众监督进行了分析,提出了完善的建议。
[Abstract]:Administration by law in the field of environmental protection concerns the environmental rights and interests of the masses and social harmony and stability. People expect the environmental administrative penalty discretion to overcome the function expectation of discretion randomness, which makes the discretion standard as the self-improvement of environmental protection department to administrate according to law. This paper makes a deep analysis on the necessity and compulsion of the setting of environmental administrative penalty discretion benchmark, the control technology and the supervision and restriction. The principle of environmental administrative penalty discretion benchmark is put forward. The determination of relevant factors should be regarded as the compulsory obligation of the environmental protection department of the country, province and city with legislative power, and the formulation of the discretion standard should be regarded as the compulsory obligation of the environmental protection department with law enforcement power at all levels. Based on the comparison of the simple technique of standard division of discretion with punishment formula and the technique of standard division of discretion, the advantages and disadvantages of different dividing techniques are distinguished, and the improvement measures are put forward. This paper analyzes the judicial supervision, internal administrative supervision and public supervision of the environmental administrative penalty discretion benchmark, and puts forward some perfect suggestions.
