承继共同正犯的责任范围

【摘要】：厘清承继共同正犯的责任范围不仅有助于解决司法实践中的问题,而且还能够将该问题与共同犯罪相衔接,蕴含丰富的理论价值。围绕承继共同正犯的责任有全面肯定说、全面否定说以及限定肯定说等不同观点,各种观点的理论基础与司法适用结果都有较大区别。通过比较和分析,限定肯定说的观点更具有科学性与合理性,不仅贯彻了因果共犯论的主张,也能够将刑法中的个人责任原则进行贯彻。
[Abstract]:To clarify the scope of the responsibility of the joint principal offender is not only helpful to solve the problem in judicial practice, but also can link the problem with the joint crime, which contains rich theoretical value. There are different viewpoints about the responsibility of inheriting the common principal offender, such as overall affirmation theory, total negation theory and limited affirmation theory. The theoretical basis of all kinds of views is different from the result of judicial application. Through comparison and analysis, the viewpoint of defining affirmation is more scientific and reasonable. It not only carries out the proposition of the theory of causality accomplice, but also carries out the principle of individual responsibility in criminal law.
