【摘要】：传销的行为自进入我国境内以来,日益严重地威胁着我们的社会,导致各种社会问题,影响社会的和谐与稳定,当前形势下必须优先消灭传销这只毒虫。但现行的法律不能单独解决所有的社会上出现的法律问题。本罪与非法经营等罪名难以区别、本罪共同犯罪主体认定等问题在司法实践适用中存在争议,解决这些问题尤为重要。本文分为五大部分,对本罪进行了一次较为系统的探析。引言的部门是通过对传销行为的起源与发展的研究从而引起对组织、领导传销活动罪的探讨。第一部分论述了本文研究目的、意义及内容,研究的方法进行总体性的概况。第二部从理论上对组织、领导传销活动罪的概念、特征、危害性进行阐述,进而更好的把握相关概念,为下文解决问题做铺垫。第三部分对组织、领导传销活动罪司法适用现状。通过代表性的案例来提出问题、分析问题、从而解决问题的逻辑结构来安排。2013年,最高法、最高检以及公安部印发了最新的,关于处理组织、领导传销犯罪的司法解释的规定,对于本罪的目前的适用现状进行了论述,组织者、领导者组织确定范围狭窄、领导传销活动罪共同犯罪主体认定困难以及本罪与非法经营等罪名难以区别的问题。第四部分阐述本罪在实务中的适用。在司法实践中,应该扩大传销人员的认定范围。本罪是必要的共同犯罪,应适用刑法分则的处罚原则。依据个案特征区别类似罪名。从而为司法机关在办理传销犯罪案件时起到良好地指导作用具有重要意义。第五部分是对本文的结论。通过以上对组织、领导传销活动罪的概念、特征及危害性等基础理论知识的研究,并且通过代表性的案例进行分析,以便司法机关在办理关于传销犯罪案件中能够更好的运用和理解相关的法律法规,在司法实践中更具有可操作性,为司法机关优先消灭传销这只毒虫提供强大的法律武器。
[Abstract]:Since the behavior of pyramid selling has come into our country, it has been threatening our society day by day, leading to all kinds of social problems and affecting the harmony and stability of the society. Under the current situation, it must be given priority to eliminate the poison of pyramid selling. However, the existing laws cannot solve all the social legal problems alone. It is difficult to distinguish this crime from the crime of illegal operation, and the identification of the subject of the joint crime is controversial in the judicial practice, so it is particularly important to solve these problems. This article is divided into five parts, and a more systematic analysis of this crime is made. The introduction of the department through the study of the origin and development of pyramid selling behavior to lead to the organization of pyramid selling activities crime. The first part discusses the purpose, significance and content of this paper. The second part theoretically expounds the concept, characteristics and harmfulness of the crime of organizing and leading pyramid selling activities, and then better grasp the related concepts, and pave the way for solving the following problems. The third part is the current situation of judicial application of the crime of leading pyramid selling. In 2013, the Supreme Law, the Supreme Procurator and the Ministry of Public Security issued the latest regulations on the judicial interpretation of the handling of organized and leading pyramid selling crimes. This paper discusses the current application of this crime, organizers, leaders to determine the narrow scope of the crime, leading pyramid selling activities crime of joint criminal subject identification difficulties, as well as this crime and illegal operation and other charges are difficult to distinguish. The fourth part expounds the application of this crime in practice. In judicial practice, the identification scope of pyramid selling personnel should be expanded. This crime is a necessary joint crime, and the punishment principle of the criminal law should be applied. Distinguish similar charges according to the characteristics of the case. Therefore, it is of great significance for judicial organs to play a good guiding role in handling pyramid selling crime cases. The fifth part is the conclusion of this paper. Through the above research on the concept, characteristics and harmfulness of the crime of organization, leadership pyramid selling activities, and through the analysis of representative cases, So that the judiciary can better use and understand the relevant laws and regulations in dealing with pyramid selling crime cases, and have more maneuverability in judicial practice, and provide a powerful legal weapon for the judicial organs to give priority to the elimination of pyramid selling.
