网络诽谤罪的司法适用问题研究

【摘要】：《关于办理利用信息网络实施诽谤等刑事案件适用法律若干问题的解释》的发布将网络空间纳入到刑法的空间效力范围之内，网络秩序也成为受刑法规制的社会公共秩序的重要组成部分。这本司法解释明确了网络诽谤行为入罪与刑罚的标准，解决了司法机关办理相关刑事案件无统一标准可依的问题。 虽然这份具有特别时代意义法律文本补充了法律中的空缺，，解决了司法实践中难以确定的网络诽谤案件问题，但是新法律的出台是否给司法实践带来了新的挑战：新的司法解释是否真的能解决之前法律缺失而产生的问题？是否还有无法解决的新的司法实务问题随即出现？本文在以上问题的思路基础上，对网络诽谤的司法认定问题进行研究解析。 本文共分为三个部分: 第一章是关于网络诽谤的概述。首先阐述了本罪概念和犯罪构成要件，并结合国内外立法，对国际上网络诽谤的去刑事化与国内的刑事入罪的趋势比较分析。 第二章从总体上把握本罪的犯罪构成基础上，阐述了各个犯罪要件的司法认定，如本罪犯罪主体的多元性，犯罪对象，即名誉权主体的进一步思考;本罪客观方面的依据数量来定罪是否妥当的问题，针对捏造、散布等行为的认定和取证问题;本罪的主体诽谤言论的制造者、散布者、转发者以及提供网络服务的运营商的责任分析认定;在主观方面，本罪由直接故意和间接故意构成的合理性分析。 第三章在明确了对网络诽谤罪的司法认定标准之后，进一步对网络诽谤罪的严格司法适用问题做出分析。笔者从现实存在的对青少年、对记者适用网络诽谤罪的严格控制问题，司法机关主动介入网络诽谤犯罪的严格控制问题以及对网络反腐问题的辩证司法问题提出几点严格司法的意见或建议。
[Abstract]:The publication of the interpretation of some applicable laws in criminal cases, such as handling the use of information network to carry out libel, brings cyberspace into the scope of the spatial effect of criminal law, and the network order has also become an important part of the social public order regulated by criminal law. This judicial interpretation clarifies the standards for the incrimination and punishment of network libel, and solves the problem that there is no unified standard for judicial organs to handle relevant criminal cases. Although this legal text of special significance complements the vacancy in the law and solves the problem of network libel cases which is difficult to be determined in judicial practice, does the introduction of the new law bring new challenges to the judicial practice: can the new judicial interpretation really solve the problems arising from the lack of the previous law? Are there any new judicial practice problems that cannot be solved immediately? On the basis of the above problems, this paper studies and analyzes the judicial identification of network slander. This paper is divided into three parts: the first chapter is an overview of network slander. First of all, the concept of this crime and the constituent elements of the crime are expounded, and combined with domestic and foreign legislation, the decriminalization of network slander in the international community and the trend of criminal incrimination in China are compared and analyzed. The second chapter, on the basis of grasping the constitution of the crime as a whole, expounds the judicial identification of each crime element, such as the pluralism of the subject of the crime, the object of the crime, that is, the further thinking of the subject of the right of reputation, the question of whether the conviction is appropriate on the basis of the quantity of the objective aspect of the crime, and the identification and evidence collection of the act of fabricating, spreading and so on. The main body of the crime slander speech maker, distributor, distributor and network service providers of the responsibility analysis; in the subjective aspect, the crime is composed of direct intent and indirect intent of the rationality analysis. The third chapter, after defining the judicial identification standard of network libel crime, further analyzes the strict judicial application of network libel crime. The author puts forward some strict judicial opinions or suggestions on the dialectical judicial problems of network anti-corruption from the strict control of network libel to teenagers and journalists, the strict control of network libel crime by judicial organs, and the dialectical judicial problems of network anti-corruption.
