论罚金刑的裁量与执行

【摘要】：本文针对我国司法实践中,在罚金刑的裁量与罚金刑的执行过程中存在的主要问题进行分析。论文第一部分针对罚金刑定义、特征以及罚金刑的优、缺点进行梳理,对罚金刑的基本概念进行解读。并通过立法和司法上的相关数据,整合论证我国罚金刑在刑罚体系中的地位在不断提升。第二部分分析了我国罚金刑存在的主要问题。罚金刑数额规定不明确、司法机关对犯罪嫌疑人缴纳能力重视不够,尤其是未成年人的罚金刑裁量问题都是我国罚金刑裁量中急需要解决的难题。笔者提出了日额罚金刑、设立犯罪嫌疑人经济调查制度以及对未成年人区分裁量的建议来解决罚金刑裁量中的相关问题。第三部分,对于罚金刑执行难的问题进行了深入的分析。我国目前罚金刑执行的司法实践中,罚金刑配套执行制度和措施不完善是导致罚金刑执行困难的主要原因。笔者建议设立财产保全、罚金刑易科等制度健全罚金刑的执行制度,可缓解并改善罚金刑执行难的问题。
[Abstract]:In the judicial practice of our country, this paper analyzes the main problems in the execution of the fine penalty and the execution of the fine penalty. The first part of the thesis is to sort out the definition, characteristics of the fine penalty and the advantages and disadvantages of the fine penalty, and to interpret the basic concept of the fine penalty. And through the relevant data on the legislation and the judicial, the status of the fine criminal in the penalty system of our country is continuously improved. The second part analyzes the main problems of fine punishment in China. The amount of the fine penalty is not clear, the judicial organs pay more attention to the criminal suspect's ability to pay, especially the fine of the fine of the minor, the problem of the urgent need to solve in the amount of the fine penalty in our country. In this paper, the author puts forward the related problems of the fine penalty, the establishment of the criminal suspect's economic investigation system and the recommendation to distinguish the minor. The third part makes an in-depth analysis of the problem of the execution of the fine penalty. In the judicial practice of the execution of the fine penalty in China, the execution system and the measures of the fine punishment are the main reasons leading to the difficulty in the execution of the fine penalty. The author suggests that the establishment of the system of property preservation and fine penalty and the execution system of fine punishment can alleviate and improve the difficulty of the execution of the fine.
