【摘要】：正根据刑法第一百七十六条之一的规定,拒不支付劳动报酬罪的主体是"用人者",包括自然人和用人单位。区别于机关、团体和事业单位,司法实践中,由于公司、企业(包括合伙企业)等经济组织形式的多元性和实际运营的复杂性,如何准确界定拒不支付劳动报酬罪的自然人主体,需要进一步探析。一、法定代表人不当然是"直接负责的主管人员"按照刑法第一百七十六条之一第二款的规定,拒不支付劳动报酬罪的自然人主体包括对单位
