【摘要】：本文以奇虎诉腾讯滥用市场支配地位一案为视角和切入点,在分析互联网产业新特点的基础上,指出互联网企业叠加式与平行式业务结构分类以及以互联网平台为竞争实现载体和以用户资源为直接目标的竞争本质等特点给相关市场界定、市场支配地位认定以及滥用市场支配地位行为的判断上带来的巨大挑战。并结合国内外反垄断法的理论和实践,对互联网产业反垄断司法实践中遇到的困境提出自己一些不太成熟的建议。首先,将互联网企业的反垄断纠纷分为相同业务结构企业之间与不同业务结构之间两种,分别适用不同的相关市场界定方法。其次,对于互联网产业的市场支配地位认定,应当改变测算方法,以用户为指标。最后,通过加强被告举证责任以改变原告举证困难的局面。
[Abstract]:Based on the case of Qihu v. Tencent abusing its dominant position in the market, this paper analyzes the new characteristics of Internet industry. It is pointed out that the characteristics of Internet enterprise superposition and parallel service structure classification, the competitive nature of Internet platform as the carrier of competition and the direct target of user resources define the relevant market. The determination of market dominant position and the judgment of abuse of market dominant position bring great challenges, and combine the theory and practice of anti-monopoly law at home and abroad. To the Internet industry antitrust judicial practice encountered difficulties to put forward their own some immature suggestions. First of all. The antitrust disputes of Internet enterprises are divided into two types: the same business structure and the different business structures, which respectively apply to different relevant market definition methods. Secondly. As to the market dominant position of Internet industry, we should change the calculation method and take the user as the index. Finally, by strengthening the burden of proof of the defendant, we can change the situation that the plaintiff is difficult to prove.
