冲突与失衡：中国数字音乐产业的版权保护研究

【摘要】：数字网络技术及通讯事业的飞速发展,为传统音乐产业变革提供了丰厚土壤。从上世界九十年代开始,数字音乐产业开始在全球范围内掀起浪潮。在目睹其日益繁盛的同时,版权问题却始终是挡在数字音乐产业持续优化升级道路上的一块巨大顽石。而随着数字音乐版权范围的不断扩大、权利主体的逐步增多,传播技术的迅猛发展等元素的相互作用,数字音乐盗版侵权行为变得越演越烈。聚焦于起步较晚,正在奋起直追中的中国数字音乐产业,版权保护的问题就更为凸显:现有版权法律的缺失与过时,P2P等互联网技术的飞速发展,有组织的盗版团体,消费者版权意识的缺乏与漠视等都使得数字音乐产业从业者举步维艰。本文将研究重点放在网络时代下中国数字音乐产业的版权保护上。通过剖析中国数字音乐产业的发展现状及实践困境,对中国数字音乐产业版权保护遭遇的冲突与失衡(特别是新媒体技术下音乐版权保护的曲折发展)进行了较为全面和详细的论述;然后以国内最为知名的网络音乐平台——QQ音乐为例,着重分析其发展十余年间对音乐版权保护作出的努力和探索;最后从法律制度、技术保护、市场运作、组织管理、用户意识五个维度为中国数字音乐产业版权保护的未来发展提供解决思路及合理建议。
[Abstract]:The rapid development of digital network technology and communication industry provides rich soil for the traditional music industry reform. Since the 1990's, the digital music industry has started to rise a wave around the world. While witnessing its growing prosperity, the copyright issue has always been a huge stone in the way of the continued optimization and upgrading of the digital music industry. With the constant expansion of the scope of digital music copyright, the gradual increase of the subject of rights, the rapid development of communication technology and other elements of the interaction, the piracy of digital music becomes more and more serious. Focusing on China's digital music industry, which started late and is catching up, the problem of copyright protection is even more prominent: the lack of existing copyright laws and the rapid development of outdated Internet technologies such as P2P, organized piracy groups, The lack and disregard of consumers' copyright consciousness makes the digital music industry difficult. This paper focuses on the copyright protection of China's digital music industry in the internet age. By analyzing the current situation and practical difficulties of the digital music industry in China, This paper discusses the conflict and imbalance of copyright protection in Chinese digital music industry (especially the tortuous development of music copyright protection under the new media technology). Then take QQ music, which is the most famous network music platform in China, as an example, focusing on the efforts and exploration of music copyright protection made during its more than ten years of development; finally, from the legal system, technical protection, market operation, organization and management. The five dimensions of user consciousness provide solutions and reasonable suggestions for the future development of copyright protection in China's digital music industry.
