我国文化产业行政指导的系统化与规范化研究

【摘要】:文化产业是我国国民经济的支柱性产业,也是满足民众精神文明需求的重要途径。而行政指导是对行政法治的补充和配合,也是对政企关系的协调与增进。善用行政指导,对于我国文化产业的全面、协调及可持续的发展,应是不无助益。行政指导方式灵活多样,为许多国家及地区普遍采用。市场经济先进国家及地区实施行政指导尤其是实施文化产业行政指导的经验和教训,颇堪我们研究和借鉴。本论文作者考究了美、英、法、德、日、韩六大国家及我国台湾地区的文化产业行政指导实践,以济于我国文化产业行政指导的系统化及规范化。为促成我国文化产业行政指导的系统化,必须加强七个方面的行政指导,包括人才培养、集聚经营、融资、版权、信息、技术、应急等方面的行政指导。而我国文化产业行政指导的规范化建设,更是当务之急。依笔者看来,为求取我国文化产业行政指导的规范化,必须认真考虑下列七个方面:一是行政指导立法完善,二是行政指导主体规范化,三是行政指导程序规范化,四是行政指导保障措施规范化,五是行政指导救济规范化,六是纯正型行政指导法律责任规范化,七是非纯正型行政指导法律责任规范化。
[Abstract]:Cultural industry is the pillar industry of our national economy and an important way to meet the needs of the people's spiritual civilization. The administrative guidance is the complement and cooperation to the administrative rule of law, and also the coordination and enhancement of the relationship between government and enterprises. The proper use of administrative guidance should be helpful to the overall, coordinated and sustainable development of our cultural industry. The way of administrative guidance is flexible and diverse, and is widely used in many countries and regions. The experience and lessons of implementing administrative guidance in advanced countries and regions of market economy, especially in cultural industry, are quite worthy of our study and reference. The author of this paper investigates the administrative guidance practice of cultural industry in six countries, including the United States, Britain, France, Germany, Japan, South Korea and Taiwan, in order to systematize and standardize the administrative guidance of cultural industry in China. In order to systematize the administrative guidance of cultural industry in China, we must strengthen the administrative guidance in seven aspects, including personnel training, agglomeration management, financing, copyright, information, technology, emergency and so on. But our country culture industry administration instruction standardization construction, is the urgent matter. From the author's point of view, in order to standardize the administrative guidance of our cultural industry, we must seriously consider the following seven aspects: first, the perfection of the administrative guidance legislation, the second is the standardization of the main body of the administrative guidance, and the third is the standardization of the administrative guidance procedure. The fourth is the standardization of administrative guidance guarantee measures, the fifth is the standardization of administrative guidance relief, the sixth is the standardization of legal responsibility of pure administrative guidance, and the seventh is the standardization of legal responsibility of non-pure administrative guidance.
