拒不支付劳动报酬罪的法律制度完善

【摘要】:据相关部门统计,随着我国社会经济的快速发展,我国进城务工人员总数达到2.7亿左右,由于近年来各地不断涌现出因“恶意欠薪”而引起的群体性事件,如何保护这样一个庞大的弱势群体,争议的焦点是是否将其纳入刑法予以规制,直至《刑法修正案(八)》通过了全国人大常委会审议,并在第四十一条将其规定为拒不支付劳动报酬罪,自此恶意欠薪入刑尘埃落定。两年后由于在司法实践出现了较多问题,最高人民法院公布了关于本罪的司法解释,并希望通过该解释的内容对本罪立法进行完善,同时解决司法实践中出现的关于本罪的具体法律适用问题。与本罪同时入刑的“危险驾驶罪”经常出现在大众视野中,但对本罪适用却几乎没有听闻,现实生活中各种因拒不支付劳动报酬引起群体性事件却屡见不鲜。针对此种现象,笔者通过对现行法律制度的解读,提出自己的观点和建议,希望对本罪在司法实践中有所裨益。本文首先从拒不支付劳动报酬罪的法律制度概况介绍开始,分析了恶意欠薪行为入刑背景以及立法规定,并列举了国外关于拒不支付劳动报酬罪的规定,通过规制措施和罪状表述比较,借鉴先进经验来完善我国法律制度;接着阐述设立拒不支付劳动报酬罪的原因:劳动报酬权是一项基本的人权,是人生存发展的重要条件;再者是细致梳理我国法律制度中拒不支付劳动报酬罪存在的问题,如劳动报酬的内涵和外延不明确,“数额较大”的标准,“有能力支付而不支付”的界定,“政府有关部门”的外延,法定从宽量刑的情节过多导致行为人逃避刑罚。最后提出了完善建议,其内容包括:扩大劳动报酬的外延,加入社会保险和住房公积金;比较结合定量分析和定性分析,完善“数额较大”的标准;区别用工主体的性质,分别拟设定了“有能力支付而不支付”的标准;分析列举了哪些是属于可以责令支付的“政府有关部门”,建议将劳资纠纷当事人拒不执行人民法院的判决、裁决纳入责令支付程序的一种;完善法定从宽量刑情节同时引入资格刑,即限定科罚后行为人从事相关行业的资格。
[Abstract]:According to the statistics of relevant departments, with the rapid development of social economy in our country, the total number of migrant workers in China has reached about 270 million. In recent years, there have been group incidents caused by "maliciously underpaid" in various places. The controversy over how to protect such a large vulnerable group is whether to bring it into the criminal law and regulate it until the "Amendment (8)" of the Criminal Law was passed through the NPC standing Committee for deliberation. The crime of refusing to pay the remuneration for work was stipulated in Article 41th, and since then, the crime of maliciously paying wages was settled. Two years later, due to more problems in judicial practice, the Supreme people's Court published a judicial interpretation of the crime. The author also hopes to perfect the legislation of this crime through the content of the explanation, and to solve the problem of the specific legal application of this crime in judicial practice. The crime of "dangerous driving", which is committed at the same time as this crime, often appears in the public view. However, the application of this crime is almost unheard of. In real life, a variety of mass incidents caused by non-payment of labor remuneration are common. In view of this phenomenon, the author puts forward his own views and suggestions through the interpretation of the current legal system. This article begins with the general introduction of the legal system of the crime of refusing to pay for labor, and analyzes the criminal background and legislative provisions of malicious acts in arrears of wages. And enumerates the foreign provisions on the crime of refusing to pay labor remuneration, through the comparison of regulatory measures and crime statements, learn from advanced experience to improve our legal system; Then it explains the reasons of the crime of refusing to pay labor remuneration: the right to labor remuneration is a basic human right and an important condition for the survival and development of human beings; moreover, the problems existing in the crime of refusing to pay labor remuneration in our legal system are carefully combed. For example, the connotation and extension of labor remuneration is unclear, the standard of "large amount", the definition of "being able to pay but not paying", and the extension of "relevant government departments". The excessive circumstances of legal leniency and sentencing cause the doer to evade the penalty. Finally, the author puts forward some perfect suggestions, including expanding the extension of labor reward, joining social insurance and housing accumulation fund, comparing quantitative analysis and qualitative analysis, To perfect the standard of "large amount", to distinguish the nature of the main body of employment, and to set the standard of "ability to pay but not to pay"; This paper analyzes and enumerates which are "relevant government departments" which can be ordered to pay, and suggests that the parties to a labor dispute refuse to carry out the judgment of the people's court and the ruling be included in the order payment procedure. Perfect the legal lenient circumstances and introduce qualification penalty, that is to say, the qualification of the actor engaged in relevant trades after punishment.
