农村基层“苍蝇式”腐败原因及治理对策研究

【摘要】：我国目前行政村的数量大约超过68万个,农村人口约有9.4亿,其中约有500万名包括村党支部书记和村主任在内的“村官”。“苍蝇之腐不逊于老虎”。村官是群众对干部形象最直接的认知,是群众透视政府公信和干部形象的窗口。农村基层腐败问题是真正直入群众眼帘的腐败问题,对群众来说,这些看得见的腐败问题远比高官腐败更印象深刻,也更容易激发民怨。“苍蝇式”腐败绝对不容轻视,这些腐败问题严重损害了干部形象,造成了极坏的社会影响。近年来,惩治的基层干部腐败案件数以万计,若细细研究会发现,每个都各有特点,偏重更是各式各样,甚至说已经渗透到了与群众有关的各个角落。从惠民补贴、征地拆迁、政策落实等多方面截留,从行贿受贿、霸道乡里、贪污公款等多种方式腐败。如果说“老虎”的腐败是披着隐身衣的暗箱操作,那么“苍蝇式腐败”就是单刀直入的大胆妄为,纯粹是简单直白的与民争利。因此,探索怎样更好的对村干部进行有效的监督和管理,对解决农村基层腐败问题具有深远的影响。本人围绕农村基层“苍蝇式”腐败这一重要的社会热点问题,以KZ区近年来的各种典型案件为例,在本人参与调查处理的案件上与实地调查研究的基础上开展论述。论文通过对本人从事案件查处工作以来的腐败相关数据的统计汇总分析,归纳出村干部“苍蝇式”腐败案件呈现出的具体特征。同时,通过参与的一连串现实案例阐述了“村官"腐败影响了社会稳定、损害了村集体和村民利益、阻碍了农村经济发展、损害了党和政府的形象、强危害了社会风气;论文经过对文献资料进行归纳整理和认真进行系统分析,从想腐败、能腐败、敢腐败三个方面分析了“苍蝇式”腐败发生的原因,想腐败的原因包括村干部文化素质普遍偏低、部分村干部存在封建腐朽思想、金钱世俗文化和潜规则盛行、封建宗法思想严重、经济落差导致的心理失衡、贪腐成本和效益比较分析,能腐败的原因包括“权力寻租”的现象、村干部拥有极大的寻租权力、对村干部的监督没有落到实处,敢腐败的原因包括村民文化素质偏低,维权意识较差、熟人社会村民举报有顾虑、村民罢免村干部制度存在缺陷、查处基层贪污腐败力量薄弱等。在此基础上,论文从“不想腐、不能腐、不敢腐”三个角度提出了提高思想文化素质,筑牢思想道德防线、建设廉政文化,倡导社会新风正气、提高村干部待遇保障,解决后顾之忧;强化上级监督、加强群众监督、注重同级监督;强化村民维权意识和提高维权能力、完善法律法规、惩治腐败不手软等一系列治理对策,从而有效遏制农村基层“苍蝇式”腐败蔓延。
[Abstract]:At present, the number of administrative villages in China is over 680000, and the rural population is about 940 million. Among them, there are about 5 million "village officials", including the secretary of the party branch and the chief of the village. Flies are as rotten as tigers. Village officials are the most direct cognition to the cadre image and the window for the masses to see through the government public trust and the cadre image. The problem of corruption at the grass-roots level in rural areas is a kind of corruption that really enters the eyes of the masses. To the masses, these visible problems of corruption are far more impressive than the corruption of senior officials, and they are also more likely to arouse people's grievances. "fly" corruption must not be ignored, these corruption seriously damaged the image of cadres, resulting in a very bad social impact. In recent years, tens of thousands of corruption cases have been punished at the grass-roots level. If we study them carefully, we will find that each has its own characteristics, and the emphasis is more and more varied, and it has even penetrated into every corner of the mass. From the benefits of subsidies, land removal, policy implementation and other aspects of interception, from bribery, domineering, embezzlement and other forms of corruption. If the corruption of "tiger" is a secret operation with hidden clothes, then "fly corruption" is a simple and straightforward way to fight for profit with the people. Therefore, exploring how to better supervise and manage the village cadres has a profound influence on solving the problem of rural grassroots corruption. Focusing on the important social hot issue of "fly type" corruption in rural areas, taking various typical cases in KZ district in recent years as an example, this paper discusses on the basis of the investigation and field investigation on the cases that I participated in the investigation and handling. Based on the statistics and analysis of the corruption-related data since I was engaged in the investigation and treatment of the case, the paper concludes the concrete characteristics of the village cadres'"fly type" corruption cases. At the same time, through the participation of a series of practical cases elaborated the "village official" corruption affected social stability, damaged the interests of the village collectives and villagers, hindered the development of rural economy, damaged the image of the party and the government, and strongly harmed the social atmosphere; The paper analyzes the reasons of "fly type" corruption from three aspects: thinking of corruption, being able to corrupt and daring to corrupt. The reasons for corruption include the low cultural quality of village cadres. Some village cadres have feudal decadent ideas, money, secular culture and hidden rules prevail, feudal patriarchal ideology is serious, psychological imbalance caused by economic disparity, comparative analysis of corruption costs and benefits. The reasons for corruption include the phenomenon of "power seeking for rent", the village cadres have great power of seeking rent, the supervision of village cadres has not been carried out, and the reasons of daring to corrupt include the low cultural quality of villagers and the poor consciousness of protecting their rights. Acquaintance society villagers report concerns, villagers recall village cadres system defects, corruption and corruption at the grass-roots level weak, and so on. On this basis, from the three angles of "do not want to rot, can't rot, dare not saproot", the paper proposes to improve the ideological and cultural quality, to build a solid ideological and moral defense, to build a clean and honest culture, to advocate a new style of society, and to improve the protection of the treatment of village cadres. To solve the problems at the back; to strengthen supervision by the superior, to strengthen supervision by the masses, to pay attention to supervision at the same level; to strengthen villagers' awareness of safeguarding their rights and to improve their ability to safeguard their rights; to improve laws and regulations; to punish corruption and not to be soft; and so on. Thus effectively curb the rural grassroots "fly" corruption spread.
