【摘要】：毒品犯罪一直是全世界犯罪问题的焦点,它直接危害人民群众的身心健康,也易引发其他社会问题,给国家和人民造成巨大的经济损失,严重阻碍了社会的稳定、和谐发展。近年来,我国加大对毒品犯罪的打击力度,整体犯罪形势虽有所好转,但毒品犯罪的重大案件仍然突出,形势不容乐观。因此,如实反映我国目前毒品犯罪重大案件的具体现状,并对其进行调查分析,找出相应的遏制对策,具有十分重大的实践和理论意义。本文主要采取卷宗调查法和访谈调查法进行调查分析,以天津市人民检察院为调查对象,对2010~2014年其所办理的毒品犯罪重大案件进行统计和分析,客观的展现目前天津地区毒品犯罪重大案件的现状,并提出针对性较强的解决对策和相关建议。本文内容分为四个部分。第一部分,简要说明本调查报告的目的和意义,即选取天津市作为样本地区的原因以及通过对天津市人民检察院2010~2014年毒品犯罪重大案件的情况分析,探究该地区毒品犯罪重大案件的现状和高发原因,在实践中找出相应的预防和遏制对策,有效降低重大毒品犯罪的发生。第二部分,对本调查报告的调查方法进行介绍,具体包括调查时间,调查地点和调查方式,即在天津市人民检察院以卷宗调查法和访谈调查法进行为期三个月的实践调查。第三部分,集中对本调查的结果进行阐释,并运用图表的方式更加详细、客观地进行分析。其主要内容包括:天津市近五年毒品犯罪重大案件总体情况及分析,主要特点及分析,犯罪人员特征及分析,以及重大案件频发的原因及分析。其中,天津市近五年毒品犯罪重大案件呈上升趋势,涉案数量和涉案人数出现快速增长势态,禁毒形势相当严峻。毒品犯罪重大案件的主要特点表现为出现越来越多隐秘化的犯罪手段,多元化的犯罪类型,多重化的毒品种类,多样化的犯罪形式等。涉毒犯罪人员多为文化程度较低的中青年男性,外来人口比例较多,青少年和老年人比重呈上升趋势。毒品犯罪重大案件频发原因主要有毒品犯罪市场日益扩大,有吸毒情节的人员贩毒情况严重;毒品犯罪打击力度不足;新型毒品犯罪日趋严重;所处地理形势较为优越、交通发达,毒品流通便捷等。第四部分,主要就惩治重大毒品犯罪提出相应对策和建议。通过对天津市近五年毒品犯罪重大案件的调查及分析,从打击和预防重大毒品犯罪两个方面,有针对性地提出解决对策。一方面,加大力度并有针对性地打击重大毒品犯罪,控制毒品的流入市场,对毒品来源开展强有力地遏制措施,紧密联系区域内部的相互协作,建立禁毒防线;遏制新型毒品犯罪活动,揭露罪犯隐秘的作案手段,严格开展秘密侦查策略,构建毒品纯度鉴定程序,加大对财产刑的适用比例和执行力度。另一方面,加大对重大毒品犯罪案件的预防建设,组织全民开展禁毒宣传教育,加大戒毒力度,加强戒毒机构建设,规范监狱管理,严格科学进行“分管分押”,实行罪犯个案矫正,全面建设惩治重大毒品犯罪的防控体系。打击和预防毒品犯罪一向是我国禁毒工作的核心,而惩治重大毒品犯罪更是重中之重。只有组织全社会力量全方位进行查处和整治,才能够最大程度地遏制毒品犯罪重大案件的发生,减少犯罪人员数量,进一步改善人民的生活,促进国家经济的发展和社会的稳定。
