水权交易的经济分析

【摘要】： 水权交易在我国还是一个新生事物。本文用经济学方法特别是法与经济学的分析方法研究水权交易，运用现代产权理论、交易成本理论、博弈论等，从制度影响人的行为的角度，分析制度对水资源配置的影响。论文共分六部分。第一部分，简要回顾和评述国内外学者关于水权制度及水权交易的相关理论观点。第二部分，我国水权交易的背景分析。我国水资源分布总体上呈南多北少、西多东少，且总体缺水、污染严重。在传统公共水权条件下，政策原因、制度原因和市场原因三方面因素导致水资源配置扭曲。第三部分，水权交易的制度前提分析。从国外水权制度及水权交易运作经验看，，水权交易是市场手段在水资源配置领域应用的产物，其有效运作的制度前提是水权的清晰界定。第四部分，设计了一个水权交易的基本框架。根据水权分配原则、方式与对象不同，将水权市场分为一级和二级市场，并建立博弈模型，用博弈论的方法分析说明了水权交易是如何实现水资源的最佳配置的。第五部分，分析了水权交易的外部效应，着重分析了水权交易导致水资源时空分布改变后，对环境、农业用水等方面的影响。第六部分，在分析了我国水权交易制度环境的基础上，得出在我国进行水权交易的有利条件与制度障碍。
[Abstract]:Water right trade is still a new thing in our country.In this paper, we use the economic method, especially the analysis method of law and economics, to study the water right transaction. By using modern property right theory, transaction cost theory and game theory, this paper analyzes the influence of institution on water resources allocation from the point of view of institutional influence on human behavior.The thesis is divided into six parts.In the first part, the author briefly reviews and comments on the theory of water right system and water right trade at home and abroad.The second part, the background analysis of water right trade in China.The distribution of water resources in our country is generally more than north and north, west and east, and water shortage and serious pollution.Under the condition of traditional public water right, the policy reason, the system reason and the market reason lead to the distortion of water resources allocation.The third part, the system premise analysis of water right transaction.From the experience of foreign countries' water right system and water right trade operation, water right transaction is the product of the application of market means in the field of water resources allocation, and the premise of its effective operation is the clear definition of water right.In the fourth part, a basic framework of water right trade is designed.According to the principle of water rights distribution, the water rights market is divided into primary and secondary markets in different ways, and a game model is established. The method of game theory is used to analyze how water rights trade realizes the optimal allocation of water resources.In the fifth part, the external effect of water right trade is analyzed, and the influence of water right trade on environment, agricultural water use and so on after the change of water resources spatial and temporal distribution is analyzed.In the sixth part, on the basis of analyzing the institutional environment of water right trading in China, the author draws the conclusion that the favorable conditions and institutional obstacles for water right trading in China.
