和谐社会中的消费合同制度

【摘要】： 消费合同是连接消费者与经营者的重要纽带。消费合同制度的完善有利于和谐社会的构建;消费合同制度的完善也需要和谐社会理念的指引。在此宏观框架的指导下,本文深入分析了消费合同制度的特质;揭示了消费者与经营者不和谐的原因;指出了在和谐社会中消费者与经营者利益的统一性。在和谐社会理念的指引下,本文重新界定了消费合同制度的根本宗旨与价值取向,认为和谐社会中的消费合同制度应当坚持实质正义,维护社会整体效率、强化合同秩序以保障真正的合同自由。在价值理论的指导下,本文分别从消费合同的环境构建、消费者实体权利的细化与增加、诉讼程序改革等几个方面对具体制度的创新提出了自己的看法。
[Abstract]:Consumer contract is an important link between consumer and operator. The consummation of the consumption contract system is conducive to the construction of a harmonious society, and the consummation of the consumption contract system also needs the guidance of the concept of a harmonious society. Under the guidance of this macro framework, this paper deeply analyzes the characteristics of the consumer contract system, reveals the causes of disharmony between consumers and operators, and points out the unity of the interests of consumers and operators in a harmonious society. Under the guidance of the concept of harmonious society, this paper redefines the basic purpose and value orientation of the consumption contract system, and holds that the consumption contract system in the harmonious society should adhere to substantive justice and maintain the overall efficiency of the society. Strengthen the order of contract to guarantee real freedom of contract. Under the guidance of value theory, this paper puts forward my own views on the innovation of specific system from the aspects of environment construction of consumer contract, refinement and increase of consumer substantive rights, reform of litigation procedure and so on.
