【摘要】：本文认为,现阶段我国实行的是社会主义公有制的土地制度,它包括社会主义全民所有制和社会主义劳动群众集体所有制。其本质包涵三个部分,土地归国家所有;土地归劳动集体所有;农民享有土地的使用权和经营权。在此基础上,2016年的三权分置改革又开创了土地改革的新起点。这些关于土地制度改革的宗旨,在本质上要达到三个目的:一是保证国家利益;二是维护集体利益;三是保障农民的利益不受侵犯,从而保证了国家整体利益的最大化。有鉴于此,本文在产权理论、资源配置理论、制度设计理论的指导下,追述了我国土地制度的演变过程,指出了现阶段我国土地制度改革面临的土地财政问题、农民利益问题,三权分置等具体问题。在此基础上,引入“激励相容机制设计理论”,在不改变目前我国土地所有制性质的条件下,设计出国家、集体、农民三者之间在土地问题上的“激励相容”机制理论。在此约束条件下,本文论述了土地激励相容机制的适用性和可能性,提出了激励相容机制实施阶段,特别强调了激励相容机制的整体目标和子目标的实现原则。这些原则包括:在不影响整体目标的条件下,要确保农民的利益;在不影响长远利益的条件下,要保证农民的利益不受影响。为使激励机制的实现,本文还从完善相关法律法规,建立健全财政利益分配制度,加强对农民权利的保证等诸方面提出了若干建议。本文引入诺贝尔经济学奖获得者赫尔维茨的激励相容机制设计理论,即在市场经济中,设计一种制度安排,使追求个人利益的行为正好与国家集体实现利益最大化的目标一致,同时满足信息成本最小化。依据这个设计理论,本文强调在满足国家整体利益和不改变我国土地所有制性质的条件下,实现个人、集体、国家三者利益的最大化,最终实现农村土地的激励相容,是本文的创新之处。
[Abstract]:This paper argues that at the present stage of our country is a socialist system of public ownership of land, which includes socialist public ownership and socialist collective ownership. The three part includes the essence, the land belongs to all countries; all the land belongs to the collective labor; farmers enjoy land use rights and management rights. On this basis, in 2016 three right separation reform and creating a new starting point for land reform. The reform of the land system's purpose, in essence, to achieve three objectives: one is to guarantee the interests of the state; the two is to protect the collective interests; the three is to protect the interests of farmers are not violated, so as to ensure the maximization of the overall interests of the state. In view of this, based on the theory of property rights, the theory of resource allocation, system design under the guidance of the theory, describes the evolution of China's land system, pointed out in our present land system reform Land finance problem, the problem of peasants' interests, the specific issues such as three rights. On this basis, the introduction of "incentive mechanism design theory, without changing the current land ownership condition, design a national, collective, farmer three on the issue of land in the" incentive compatibility "mechanism theory. Under this constraint condition, this paper discusses the applicability and possibility of incentive mechanism of the land, put forward the incentive mechanism implementation stage, with particular emphasis on the implementation of the principle of incentive compatibility mechanism of the overall goals and sub goals. In order to make the implementation of the incentive mechanism, this paper improve the relevant laws and regulations, establish a sound distribution system of financial interests, strengthen the agricultural Put forward some suggestions to guarantee civil rights and other aspects. This paper introduced Nobel laureate Hurwitz incentive mechanism design theory, namely in the market economy, design a kind of system, the pursuit of personal interests and collective right countries achieve maximum benefits of the same goal, at the same time to meet the information cost minimization. According to the design theory, this paper emphasizes to meet the overall interests of the state and does not change the nature of land ownership system in our country under the condition of the realization of individual, collective, maximization of national interests of the three rural land, finally realize the incentive compatibility, is the innovation of this paper.
