【摘要】：发展外海渔业是应对近海渔业资源衰退的必然出路。为此,《国务院关于促进海洋渔业持续健康发展的若干意见》(国发[2013]11)提出了“控制近海,拓展外海,发展远洋”的生产方针,在国家层面上将推进外海渔业的发展明确地提上了日程。随着党的十八大“海洋强国”战略的提出以及国务院批准成立海南省三沙市,南海外海渔业资源的开发利用面临着前所未有的良好发展机遇。然而,当前南海外海渔业资源开发利用的境况是令人堪忧的。外海渔获量比重过小、作业结构不合理、开发主体“单打独斗”的开发方式、开发利用的无序性和低效率以及涉外事件频发等都为发展南海外海渔业蒙上了阴影。因而,拓展南海外海渔业,促进其开发利用的科学、合理、有序、有效运行亟需机制构建和政策研究方面的理论指导。本文在对南海外海渔业的相关概念进行界定的前提下,以外部性理论、可持续发展理论、新制度经济学理论、治理理论、博弈论等为理论基础,阐述了南海外海渔业资源开发利用的现状及存在的问题,并据此构建了南海外海渔业资源开发利用的机制,提出了促进南海外海渔业科学、有序发展的政策建议。全文共分为五大部分:第一部分是导论。介绍了文章的选题背景和意义、研究方法、研究技术路线、创新与不足之处以及国内外关于本论题的研究进展,并作出了相应评析。第二部分是相关概念界定及研究的理论基础。文章依次对近海、外海、近海渔业、远洋渔业、外海渔业、南海渔业区划、南海外海渔业等概念进行辨析,界定了本文的研究范围。第三部分是开发利用现状的阐述。采用文献研究法、比较研究法、实证调查法等研究方法对南海外海渔业资源开发利用的现状进行研究,阐明了其存在着开发主体单一、作业结构不合理、开发存在无序性及低效性、未形成有效的开发利用机制以及缺乏专门的政策支持等问题。第四部分是开发利用机制的构建。基于前述内容构建了南海外海渔业资源开发利用的政府主导下的多元主体协调机制,对其基本框架、主导机制、辅助机制和参与机制进行重塑或设计;基于区域划分的角度,分别构建了争议区的开发利用机制和非争议区的开发利用机制;从具体内容出发,构建了南海外海渔业资源开发利用的资源调查机制和资源共享机制、海洋与渔业灾害应对机制以及可持续开发利用的保护机制。最后,提出了推进南海外海资源开发利用的科学可持续发展的政策建议。从战略层面、基本层面、具体层面三个层面层层深入和细化,提出构建以树立可持续发展理念、建立合作开发模式为宏观战略指导,以制定南海渔业资源开发行动计划、完善各类渔业合作协议为中观行动步骤,以改进和完善渔业补贴政策、渔业保险政策、渔业科技政策、海洋渔业权益维护政策等微观政策为主要框架的政策体系,推进我国南海外海渔业资源开发利用的科学有序发展,力促我国建设21世纪海洋强国伟大战略目标的实现。
