武汉城市圈农村土地流转模式研究

【摘要】:农村土地流转归根到底流转的是土地的使用权流转,农村土地的承包经营权是不流转的,仍然属于农民自身。农民是将其拥有土地承包经营权的耕地按照有关约定流转给承包商。尽管每年农村土地流转的总体规模在逐步扩大,但是绝大多数地区的农村土地流转率并不高。主要是非农收入不稳定、保障体系不完善、流转程序不规范、土地市场不健全、规模经营缺资金等因素限制了农地的正常流转。武汉城市圈农村土地流转同样存在上述问题,但也呈现出流转意愿不强烈、流转土地不集中、流转程序不规范和保障体系不完善等特点。在借鉴国内外相关优秀研究成果的基础上,通过对武汉市城市圈里有代表意义的乡镇进行实地调研,借此来研究武汉城市圈里农村土地流转的一些情况,研究目前土地流转所涉及的一系列问题。寻找其产生的原因和背景,从而对症下药地提出解决建议和对策。在现有土地流转的常见模式下,对出租、转包、转让、互换和入股等现有的一些基本形式进行融合,在考虑到农户的基本要求和武汉市城市圈土地的实际情况下,建议在继续采取转包、出租和入股等初级模式的基础上,创新或演化出“土地银行模式”和“土地股份制流转模式”。同时,武汉城市圈的土地流转应通过加大政策支持力度,完善相关法律法规,建立统一圈内流转市场,使各项权能体系更加规范,完善社会保障制度,以保障土地流转的双方达成共识,不存在后顾之忧。也使得土地资源得到更好的利用,更好的满足武汉城市圈“两型”社会的发展需求。
[Abstract]:The circulation of rural land in the final analysis is the transfer of land use rights, rural land contractual management right is not circulation. Farmers still belong to the farmers themselves. Farmers transfer the farmland they own the land contract management right to the contractor according to the relevant agreement, although the overall scale of the rural land circulation is gradually expanding every year. But most of the rural land transfer rate is not high, mainly non-agricultural income instability, security system is not perfect, circulation procedures are not standard, land market is not perfect. The scale management lack of funds and other factors limit the normal circulation of agricultural land. Wuhan urban circle rural land circulation also exists the above problems, but also shows that the transfer will is not strong, circulation land is not centralized. Flow procedures are not standardized and the security system is not perfect and so on. On the basis of reference of domestic and foreign outstanding research results, through the Wuhan city circle has representative significance of the township field investigation. In order to study the situation of rural land circulation in Wuhan urban circle, the paper studies a series of problems involved in the current land circulation, and looks for the causes and background of the land circulation. In the light of the common mode of land circulation, some basic forms of leasing, subcontracting, transfer, swap and equity acquisition are merged. In consideration of the basic requirements of farmers and the actual situation of Wuhan urban area land, it is proposed to continue to take subcontracting, leasing and equity acquisition and other primary models on the basis. Innovation or evolution of "land banking model" and "land shareholding circulation model". At the same time, Wuhan urban area land circulation should be through increasing policy support, improve the relevant laws and regulations. Establish a unified circulation market within the circle, make the power system more standardized, improve the social security system, in order to ensure that both sides of the land transfer reached a consensus, there is no worry behind, but also make better use of land resources. Better meet the Wuhan City Circle "two-type" social development needs.
