【摘要】：土地流转问题一直是我国政府及社会各界关注的重点。近两年来党中央、国务院多次发布关于土地流转政策的相关文件,其中影响力最大的是2015年11月份发布的《深化农村改革综合性实施方案》,该方案强调了集体所有权落实、稳定农户承包权、放活土地经营权等内容。在2016年11月,党中央国务院又发布的《关于完善农村土地所有权承包权经营权分置办法的意见》明确规定了土地确权办法。由此可见,政府在农村土地流转上的政治职能已发挥的越来越完善。然而,随着农村向工业化、城镇化的深入发展,大量农业人口向城市转移,以往小农经营模式下的耕地得不到有效的利用而使得土地和人口矛盾进一步激化。作为土地资源的直接管理者,基层政府如何整合资源、合理利用土地,怎样进行土地改革、更好的实现农村土地流转已逐渐被各地政府提为重要日程。本文将对我国基层政府在农村土地流转中的职能履行进行研究,结合2017年最新土地确权政策和全国两会中提及的土地流转相关内容,阐述基层政府参与土地流转的原因、现状、偏差及之后的主要职能履行。因为我国正处在土地改革的过渡性阶段,所以基层政府在农村土地流转中的职能也需要随着土地确权等政策进一步优化。目前政府职能偏差主要体现在对土地流转市场的监督和管理上,包含基层政府强行推动土地流转、土地流转监督法律不健全和政府内部官员的监管不当等问题。综合之前相关学者的研究和我国农村实际土地流转的相关数据,认为应更加注重基层政府监督、管理、引导和服务这四项职能的综合性发挥。只有充分执行基层政府的协助管理职能,完善土地流转的价值评估和监督机制,建立更加全面的土地流转工作程序和相关制度执行模式,才能切实保障农民的个人利益,促进农业经济水平的发展。
[Abstract]:The issue of land circulation has been the focus of our government and the community. In the past two years, the Party Central Committee and the State Council have issued many documents on land transfer policy. One of the most influential is the "Comprehensive implementation Plan for deepening Rural Reform" issued in November 2015, which emphasizes the implementation of collective ownership and stability of farmers' right to contract. The political function of the government in the rural land circulation has been playing more and more perfect. As the direct manager of land resources, the grass-roots government how to integrate resources and make rational use of land because of the lack of effective use of arable land under the management mode of small farmers in the past, which further intensifies the contradiction between land and population. How to carry out land reform and better realize rural land transfer has been gradually put forward as an important agenda by local governments. This paper will study the function of grass-roots government in rural land transfer. Combined with the latest policy of confirming land rights in 2017 and the relevant contents of land circulation mentioned in the national two sessions, this paper expounds the reasons and current situation of grass-roots governments participating in land circulation. Only by establishing a more comprehensive working procedure of land circulation and implementing mode of related system can the individual interests of farmers be protected and the development of agricultural economy level be promoted.
