我国城乡一体化进程中的农村土地流转问题研究

【摘要】：城乡一体化是一个长期发展的历史过程,其目的在于促进市场和服务等生产和生活要素在城乡之间的合理流通,是城乡之间可以共享现代文明和科技发展的最新成果,逐步缩小城乡差距,最终实现共同富裕。随着改革开放以来我国经济社会的不断发展、城市化进程的不断加快,我国各级城市在改造和扩建的过程中,土地资源供需之间的矛盾凸显出来。由于我国农村的土地制度对土地的自由流转有很大的限制和约束,导致近年来城乡一体化的快速发展对土地资源的需求量不断增长,而城市化又吸引大批农民涌入城市,这就造成了部分土地的荒芜、闲置,因此,农村土地流转是一个亟待解决的问题。在这种情况下,我国颁布了一系列有利于加快农村土地流转的政策,各地纷纷开始了对农村土地流转的探索。目前我国农村土地流转有土地承包经营权流转、农村集体建设用地使用权流转、宅基地使用权流转三种形式。我国农村土地流转的过程中存在种种问题,本文主要在充分理解和把握马克思主义的基本立场、观点的基础上,结合中国实际,总结我国农村土地流转和城乡一体化建设经验教训,运用马克思主义的基本原理,分析我国农村土地流转和城乡一体化的相关问题。首先对农村土地流转和城乡一体化建设的进行理论梳理,找出农村土地流转与城乡一体化建设的关系。然后,着重分析在我国城乡一体化建设过程中农村土地流转的现状及存在的问题,例如农村土地流转价格机制扭曲、农村土地收益分配不公、农村土地流转的政策法规健全、农村土地流转风险保障机制不完善、农村土地流转纠纷解决机构缺位、缺乏流转土地使用的监管。最后,结合我国现阶段的农村土地制度和土地流转的形式和存在的问题,对加快我国农村土地流转提出合理的建议。
[Abstract]:The integration of urban and rural areas is a historical process of long-term development, the purpose of which is to promote the rational circulation of production and life elements such as markets and services between urban and rural areas, and to share the latest achievements in the development of modern civilization and science and technology between urban and rural areas. Gradually narrow the gap between urban and rural areas, and ultimately achieve common prosperity. With the continuous development of economy and society and the acceleration of urbanization, the contradiction between supply and demand of land resources has been highlighted in the process of transformation and expansion of cities at all levels in China. Because the rural land system of our country has great restrictions and constraints on the free circulation of land, the rapid development of urban and rural integration in recent years has led to a growing demand for land resources, and urbanization has attracted a large number of farmers to flood into cities. This has caused the wasteland of part of land, idle, therefore, the rural land circulation is a problem to be solved urgently. In this case, China has promulgated a series of policies conducive to speeding up the transfer of rural land, and various regions have begun to explore the rural land circulation. At present, there are three forms of rural land circulation in our country: land contractual management right transfer, rural collective construction land use right circulation and homestead use right circulation. There are various problems in the process of rural land circulation in our country. This paper, on the basis of fully understanding and grasping the basic position and viewpoint of Marxism, combines the reality of China. This paper summarizes the experience and lessons of rural land circulation and urban-rural integration construction in China, and analyzes the related problems of rural land circulation and urban-rural integration by using the basic principles of Marxism. Firstly, the relationship between rural land circulation and urban-rural integration construction is found out by combing the theory of rural land transfer and urban-rural integration construction. Then, it analyzes the current situation and existing problems of rural land circulation in the process of urban-rural integration construction, such as distorted price mechanism of rural land circulation, unfair distribution of rural land income, sound policies and regulations of rural land circulation. The rural land circulation risk protection mechanism is not perfect, the rural land circulation dispute settlement organization is absent, lacks the circulation land use supervision. Finally, combining the current rural land system and the form and existing problems of land circulation in our country, some reasonable suggestions are put forward to speed up the rural land circulation in our country.
