河源市农村征地拆迁群体性事件成因及对策研究

【摘要】：在全国加速经济发展和城镇化进程下,出于提质扩容、旧址改建、基础设施加建等多种城镇建设的需求,农村征地拆迁成为常见的社会现象,对于河源这种发展中城市来说更是普遍。但是,土地所有权的变更会带来一系列利益分配等问题,如果没有得到恰当的处理,那么随农村征地拆迁而来的便是波及范围广、破坏性强的农村征地拆迁群体性事件。对广义的农村征地拆迁引发的群体性事件进行分析,就表现形式而言主要有聚众上访类、游行示威类和违反社会公共秩序类;事件过程特点具有明确的目的性、一定的组织计划性、不同程度的暴力破坏性并且容易迁移;就社会影响而言,积极的方面是失地农民得到了宣泄负面情绪而政府收到了警示提醒的作用,但弊大于利,消极的方面是既影响社会秩序又降低政府公信力,成为和谐社会的隐患。基于妥善处理农村征地拆迁群体性事件的紧迫性,本研究先是就农村征地拆迁相关概念进行阐述,其次通过将“社会冲突理论”、“应急管理理论”作为理论基础,对河源农村征地拆迁引发的群体性事件现状和河源市自身的特性及存在的问题分析梳理。然后,从中对导致农村征地拆迁引发群体事件的原因进行详细的剖析发现,失地农民纠结成队参与农村征地拆迁群体性事件的客观条件是政府征地工作不透明不到位并且应急管理能力低,负面心理基础由因被征地后没有得到充分、及时补偿而产生被剥夺感、不安全感并对政府失信,在从众的队伍里失去自我约束而奠定。最后,根据以上分析,较为全面、系统地提出了从改进征地拆迁补偿机制、构建征地拆迁失地村民生活保障机制、改善征地拆迁过程中民意诉求机制到构建应急管理预案,并落实法规加强监管的农村征地拆迁引发群体性事件对策及建议,以求为河源市今后在农村征地拆迁避免群体性事件提供参考。
[Abstract]:In the process of accelerating economic development and urbanization throughout the country, rural land expropriation and demolition have become a common social phenomenon for the demand of upgrading and expansion, reconstruction of the old sites, and the construction of infrastructure and other cities and towns. It is more common for the urban development of Heyuan. However, the change of land ownership will bring a series of problems of distribution of interests, If it is not properly handled, then the rural land expropriation and demolition come from a wide range of devastating rural land expropriation and removal of mass incidents. The analysis of the group incidents caused by the broad rural land expropriation and demolition is mainly the types of visits, demonstrations and social public order. The characteristics of the event process have a clear purpose, a certain organizational plan, a certain degree of violence and destructive and easy to migrate. In terms of social influence, the positive aspect is that the lost peasants have the negative emotion and the government receives the warning and reminding, but the disadvantage is greater than the benefit, and the negative aspect is not only affecting the social order but also the decline of the social order. The low government credibility has become a hidden danger in a harmonious society. Based on the urgency of properly handling the rural land expropriation and demolition mass incidents, this study first expounds the related concepts of rural land expropriation and demolition, followed by the theory of "social conflict theory" and "emergency management theory" as the rationale, and the group caused by the rural land expropriation and demolition in Heyuan. The present situation of sexual events and the characteristics and existing problems of Heyuan city are analyzed and analyzed. Then, from the detailed analysis of the causes of rural land expropriation and demolition, the objective conditions for the entanglement of land lost farmers to participate in the rural land expropriation and demolition are not transparent and emergency. Low management ability, the negative psychological foundation is caused by the lack of sufficient and timely compensation after the land expropriation, resulting in the sense of deprivation, insecurity and the government's loss of self restraint in the crowd. Finally, according to the above analysis, the compensation mechanism of land expropriation and demolition is put forward and the land expropriation and demolition is lost. The livelihood guarantee mechanism of the villagers, the improvement of the public opinion demand mechanism in the process of land expropriation and removal to the construction of emergency management plan, and the implementation of the measures and suggestions on rural land expropriation and demolition of rural land expropriation and demolition, in order to provide reference for Heyuan in the future in rural land expropriation and removal to avoid groups.
