农民土地承包权有偿退出法律机制的建构

【摘要】：城市化背景下,越来越多的农民进城落户,农村土地承包权有偿退出法律机制的构建是顺应时代发展的新尝试。现有法律缺乏明确的集体经济组织成立、变更和解散的法律规定,对集体成员资格的取得和丧失规定不明确。同时,缺乏对于承包权行使过程中的具体规定,包括退出补偿法定标准及方式,导致具体操作常常于法无据。而对于承包权退出这一问题,我国法律与政策的规定又不尽一致。因此,承包地退出可能会产生一定的法律风险、制度风险以及社会风险。在退出过程的不同阶段应注意不同类型的风险防范,建立承包地退出风险保障机制等。破解这一问题的出路在于构建合理的退出与补偿机制:构建多元化的农民承包权有偿退出方式,明确补偿对象和多渠道资金来源,构建科学合理的补偿标准等。
[Abstract]:Under the background of urbanization, more and more farmers enter the city to settle down. The construction of the legal mechanism of paid withdrawal of rural land contract right is a new attempt to conform to the development of the times. The existing laws lack clear provisions on the establishment, alteration and dissolution of collective economic organizations, and on the acquisition and loss of collective membership. At the same time, the lack of specific provisions in the process of the exercise of contract rights, including withdrawal from the statutory standards and methods of compensation, resulting in specific operations often without legal basis. However, the law and policy of our country are not consistent with the withdrawal of contract right. Therefore, the withdrawal of contracted land may produce certain legal risk, institutional risk and social risk. Different types of risk prevention should be paid attention to in different stages of withdrawal process, and risk protection mechanism of contracted land withdrawal should be established. The way out to solve this problem lies in the construction of reasonable withdrawal and compensation mechanism, the construction of diversified ways of peasants' paid withdrawal of contract right, the determination of compensation object and the source of multi-channel funds, and the construction of scientific and reasonable compensation standard, etc.
