我国土地承包经营权抵押融资的相关制度构建

【摘要】:改革开放以来,我国经济发展迅速,当前已发展成为世界第二大经济体,特别是国家在工业、科技事业上的发展更是有了质的飞跃。然而,农村农业的发展严重滞后,一直制约着我国由一个经济大国向经济强国的转化。近年来,中央强调了这个方面,在各方民众的支持下,一定要处理好三个核心问题,所以就发布了一些规定,要彻底的告别“三农”问题。促进农村经济的发展,提高农民的生活水平,农业发展的关键无非两点,一是农业资金的投入,二是农村土地的利用,特别是农民土地承包经营权的利用。当前,我国正处于全面深化改革的阶段,而农村土地经营权的抵押贷款的试点改革也全面展开。然而,基于理论和实践的土地抵押贷款融资模式仍处于探索阶段,尚未形成成熟的制度。基于以往的研究,结合相关理论和我国现状,实际上再吸取国外研究经验,分析中国目前的土地抵押融资问题制度,并按照目前的原则,结合土地抵押融资创新,为农村土地抵押融资制度创新提出了相关制度构想。本文除引言和结语外,分为五个部分:第一部分,介绍农村土地承包经营权抵押融资的相关概念;第二部分,对我国农村土地承包经营权的抵押融资实施的相关法律规定和政策的变革予以评述;第三部分,分析我国土地承包经营权融资的试点现状,并且探讨农村土地承包经营权抵押实施中遭遇的困境和问题;第四部分,结合外国和台湾地区的农村土地按揭融资实践,笔者在美国,德国,台湾地区的这一部分作为对照和我国加入了一些介绍,具体的就是一些在实际里面的做法,希望可以为咱们国家的抵押主要是关于农村土地方面的一些问题提供一点借鉴;第五部分提出了农村土地承包履行法定制度等抵押融资权的措施,确认了农村土地抵押制度的合同管理;完善中国土地登记制度的承包权;完善承包土地流转监督机制;完善中国农村社会保障制度;完善我国农村土地纠纷解决机制;建立中国市场土地流转合同经营权支持体系;制度上要搞好完善,农村土地承包经营很是重要,另一个就是要提高一下评估体系的时评能力,当然是指土地承包经营权上的一个价值,最后一个就是一个流通模式要谨慎的完善,这个很重要,是关键,要做好强化,为实施农村土地承包经营权抵押融资提供依据。
[Abstract]:Since the reform and opening up, China's economy has developed rapidly, and has developed into the second largest economy in the world, especially the development of the country in industry, science and technology has made a qualitative leap forward. However, the development of rural agriculture lags behind seriously, which restricts the transformation from a large economic country to an economic power. In recent years, the Central Committee has emphasized this aspect. With the support of the people of all quarters, we must deal with the three core issues, so we have issued some regulations to bid farewell to the issue of "agriculture, countryside and farmers." To promote the development of rural economy and improve the living standard of farmers, the key to agricultural development is the input of agricultural funds and the utilization of rural land, especially the use of farmers' right to contract and manage land. At present, our country is in the stage of comprehensive deepening reform, and the pilot reform of mortgage loan of rural land management right is also carried out in an all-round way. However, the land mortgage financing model based on theory and practice is still in the exploratory stage and has not yet formed a mature system. Based on the previous research, combined with the relevant theories and the present situation of our country, and drawing on the foreign research experience, this paper analyzes the current system of land mortgage financing in China, and according to the current principles, combining with the innovation of land mortgage financing, For the rural land mortgage financing system innovation, put forward the related system concept. In addition to the introduction and conclusion, this paper is divided into five parts: the first part introduces the related concepts of the rural land contractual management right mortgage financing; the second part, This paper reviews the relevant legal provisions and policy changes in the implementation of mortgage financing of rural land contractual management right in China. The third part analyzes the status quo of the pilot projects of land contractual management right financing in China. And discusses the difficulties and problems encountered in the implementation of rural land contractual management right mortgage. Part IV, combining with the foreign and Taiwan rural land mortgage financing practice, the author in the United States, Germany, This part of the Taiwan area as a comparison with our country joined some introduction, specific is some in the actual practice, hoping to provide some reference for our country's mortgage is mainly about the rural land aspects of some issues; The fifth part puts forward the measures of the right of mortgage financing, such as carrying out the legal system of the rural land contract, confirming the contract management of the rural land mortgage system, perfecting the contract right of the land registration system in China, perfecting the supervision mechanism of the contracted land circulation; To perfect China's rural social security system, to perfect the rural land dispute resolution mechanism in China, to establish a supporting system for the contractual management of land circulation in the Chinese market, and to improve the system, it is very important for rural land to be contracted and operated. The other is to improve the current evaluation capability of the evaluation system. Of course, it refers to a value in the right to contract land management. The last one is that a circulation model should be carefully improved. This is very important, it is the key, and we must do a good job of strengthening it. For the implementation of rural land contractual management right mortgage financing to provide the basis.
