农村集体经营性建设用地入市的土地增值收益分配研究

【摘要】:在我国新型城镇化、工业化快速推进的背景之下,农地非农化问题突出:一方面土地利用方式粗放、使用效率不高,另一方面,由于城乡二元土地制度的限制,农民土地权益未能得到有效保障。建立城乡统一的建设用地市场,盘活农民资产、增加农民财产性收入成为深化农村土地制度改革的重点内容。2015年1月,国家出台了《关于农村土地征收、集体经营性建设用地入市、宅基地制度改革试点工作的意见》,其中,集体经营性建设用地直接入市打破了城乡二元土地制度的约束,是一种新的制度安排尝试。集体经营性建设用地入市土地增值收益的分配,关系到国家、集体和农民等多方的切身利益,成为亟需解决的重要现实问题。本文以集体经营性建设用地为研究对象,运用理论分析法、案例分析法、比较研究法等研究方法,探讨土地增值收益的成因,分别对现有土地制度下农地征收模式和集体经营性建设用地入市模式的增值收益形成机理进行了对比分析,结果表明,农地征收模式下,政府和开发商享有远高于农民的土地增值收益,在集体经营性建设用地入市模式下,政府以收取土地收益调节金的方式享有一定比例的增值收益,农民集体享有的增值收益大幅提高。进一步选择集体经营性建设用地入市典型试点地区,从政策、交易情况、增值收益分配等四个方面进行了比较分析,研究表明,四个典型试点地区均采取拍卖、挂牌等交易入市,但增值收益水平、分配比例、分配方式存在明显的地区差异。总体来讲,集体经营性建设用地入市模式较征收模式使农村土地财产权利得到凸显,农民集体更好的分享到增值收益。总结土地增值收益具体实践中的经验,结合我国土地增值收益分配中现存的问题,从完善法律法规、优化增值收益分配、完善监督管理三方面提出了促进土地增值收益合理分配的对策与建议。
[Abstract]:Under the background of new urbanization and rapid development of industrialization in our country, the problem of farmland conversion is prominent: on the one hand, extensive land use mode, inefficient use, on the other hand, because of the restriction of dual land system in urban and rural areas, Farmers' land rights and interests have not been effectively protected. The establishment of a unified construction land market between urban and rural areas, the activation of farmers' assets and the increase of peasants' property income have become the key contents of deepening the reform of the rural land system. Opinions on the pilot work of the Reform of the Collective Management Construction Land and the Housing Base system. Among them, the collective management construction land directly broke the restriction of the dual land system in urban and rural areas, and it is a new institutional arrangement attempt. The distribution of the value-added income of the land entering the market for collective management construction land is related to the vital interests of the country, the collective and the farmers, and has become an important practical problem that needs to be solved. This article takes the collective management construction land as the research object, uses the theory analysis method, the case analysis method, the comparison research method and so on research method, discusses the reason of the land increment income, The paper compares and analyzes the mechanism of value-added income formation of farmland expropriation model and collective management construction land market entry model under the existing land system. The results show that, under the farmland expropriation mode, The government and the developers enjoy much higher land value-added income than the farmers. Under the mode of collective management construction land entering the market, the government receives a certain proportion of the value-added income in the form of land income adjustment fees. The value-added income enjoyed by farmers collectively has increased substantially. Further selecting the collective operating construction land to enter the typical pilot areas of the city, from the policy, transaction situation, value-added income distribution and other four aspects of comparative analysis, the study shows that the four typical pilot areas are auctioned. Listing and other transactions enter the market, but there are significant regional differences in value-added income level, distribution ratio and distribution mode. Generally speaking, the collective management construction land market mode than the expropriation model makes the rural land property rights prominent, farmers share better value-added income. Summing up the experience in the concrete practice of land value-added income, combining with the existing problems in the distribution of land value-added income in our country, from perfecting laws and regulations, optimizing the distribution of value-added income, The countermeasures and suggestions of improving supervision and management are put forward to promote the rational distribution of land value-added income.
