“三权分置”与“长久不变”的关联

【摘要】："长久不变"是"三权分置"有效实现的前提和基础,而"三权分置"的有效实现有助于巩固"长久不变"的制度基础。"三权分置"与"长久不变"政策协同困境主要表现在政策目标、政策制定、政策范围、政策执行四个层面。促进"三权分置"与"长久不变"政策协同,应从如下方面着手:一是成立"集体经济组织"机构,赋予土地"所有权"完整权能,落实土地"所有权";二是确定"集体经济组织"成员,界定土地"承包权"权利内涵,稳定土地"承包权";三是探索多种途径农业经营模式,界定土地"经营权"物权性质,放活土地"经营权"。

" The dilemma of policy coordination between "three power division" and "long-term invariance" is mainly manifested in four levels: policy objective, policy formulation, policy scope and policy implementation. To promote the policy synergy between "three rights division" and "long-term invariance", we should start from the following aspects: first, set up "collective economic organization" organization, endow land "ownership" with complete power, and implement land "ownership"; Second, determine the members of "collective economic organization", define the connotation of land "contract right" and stabilize land "contract right"; Third, explore various ways of agricultural management mode, define the real right nature of land "management right", release land "management right".
