征地留用地在城中村转型中的作用

【摘要】:征地留用地是政府在征用集体土地时,按照征地面积的一定比例核定用地指标,让被征地村级集体用于发展二、三产业,壮大集体经济,安置失地农民。虽然征地留用地仍为原"村籍"农民共有,但土地性质已转为国有,开发和使用不存在制度障碍。通过物业入股、合作开发、自主开发等多种留用地开发方式,引导原村级集体经济由出租物业经济向投资型、产业服务型经济转型。公司制或股份合作制管理模式使原村级集体经济逐渐向市场主体转型。折股量化的收入分配方式使原"村籍"农民转为"股民",解决了村级集体经济产权虚置难题。留用地是我国现有土地制度下集体经济成功转型的一条途径,建议国家将其法制化和制度化。
[Abstract]:Land expropriation and retention land is the government in the acquisition of collective land, according to a certain proportion of the land acquisition area approved land indicators, let the village collective land expropriated for the development of secondary and tertiary industries, strengthen the collective economy, land loss farmers. Although the land requisition and use is still shared by the former "village" peasants, the nature of the land has been transferred to the state, and there are no institutional obstacles to the development and use of the land. Through the ways of property ownership, cooperative development, independent development, etc., it guides the transformation of the village level collective economy from the rental property economy to the investment type and the industrial service type economy. The management mode of corporation system or share-share cooperation system makes the village-level collective economy gradually transform to the main body of the market. The quantitative income distribution way of stock exchange makes the former "village nationality" peasants become "stockholders", and solves the problem of virtual ownership of village collective economy. Retention land is a way of successful transformation of collective economy under the present land system of our country. It is suggested that the country should legalize and institutionalize it.
