农村集体土地“三库”集成方法研究

【摘要】:伴随着计算机、数据库以及网络技术的发展,全国土地数据的管理实现了信息化,避免了原本纸质管理的不足。随着各农村集体土地确权登记发证工作的推进,各地纷纷建立了“三库”,即:农村集体土地所有权数据库、农村集体建设用地使用权数据库、农村集体土地承包经营权数据库来管理集体土地,然而随着农村集体土地内的各类土地的不断流动,造成土地权属界线不清晰,进而导致农村矛盾加剧,因此迫切需要对农村内部的各类土地进行统一管理来明确土地的界限,保护土地权利人的合法权益。本文尝试对农村集体土地“三库”进行集成。在农村集体土地“三库”集成方法的研究过程中,本文首先对农村集体土地所有权、使用权以及对应的数据库进行了研究和分析,奠定了“三库”集成的理论基础;其次对“三库”中空间数据的含义、组织与管理、属性数据、权利主体信息等进行了具体的探讨与设计;最后结合具体的数据完成了“三库”的集成,实现了图形与属性的查询,并对“三库”的实际应用进行了分析研究。本文主要做了以下工作:(1)以农村集体土地权利为基础,对相应的“三库”:农村集体土地所有权数据库、农村集体建设用地使用权数据库、农村集体土地承包经营权数据库从目的、数学基础、数据库内容以及权属调查等方面进行分析。(2)将土地权属与土地用途相结合,对农村集体土地的地类图斑划分为:建设用地使用权宗地、农业用地使用权宗地、地类图斑地块,并解释了各部分的含义,为“三库”的空间数据组织奠定了理论基础。(3)以现有农村集体土地数据库为基础,具体设计了“三库”的空间数据的组织与管理方式,并设计每个图层的属性结构,使得“三库”集图形与属性于一体;同时为实现土地确权的目的,对土地确权过程中的权利主体进行总结并设计了其信息表,将土地与权利主体联系起来,这也是“三库”的现实需要。(4)运用Arc GIS软件的个人数据库功能,结合榆林市榆阳区项目数据,对数据库的空间数据进行了集成实现,并实现图形属性信息的查询,做到图属一致。(5)分析了“三库”在不动产统一登记工作、土地确权登记发证工作、基本农田划定工作、土地勘测定界工作这四方面的应用。“三库”的实现,可以对农村集体内的各类土地以及房屋进行统一组织与管理,避免土地在流转过程中出现的权属界线不清而导致的农村矛盾加剧的现象,有力保护各农民集体以及农民的土地财产权不受侵犯,同时为农村不动产登记工作提供数据支持。
[Abstract]:With the development of computer, database and network technology, the management of national land data realizes information, and avoids the shortage of original paper management. With the promotion of the registration and issuance of the rural collective land ownership, three databases have been set up, namely, the rural collective land ownership database, the rural collective construction land use right database, the rural collective construction land use right database, the rural collective land ownership database and the rural collective construction land use right database. Rural collective land contractual management right database to manage collective land, but with the continuous flow of all kinds of land in rural collective land, the land ownership line is not clear, which leads to the intensification of rural contradictions. Therefore, there is an urgent need for unified management of all kinds of land in rural areas in order to define the limits of land and protect the legitimate rights and interests of land owners. This paper attempts to integrate the three libraries of rural collective land. In the research process of the integration method of rural collective land "three bases", this paper firstly studies and analyzes the ownership, right of use and corresponding database of rural collective land, which lays the theoretical foundation of the integration of "three bases". Secondly, the meaning of spatial data, organization and management, attribute data and rights subject information in "three databases" are discussed and designed in detail. Finally, the integration of "three libraries" is completed, the query of graph and attribute is realized, and the practical application of "three libraries" is analyzed and studied. This paper mainly does the following work: (1) based on the rural collective land rights, the corresponding "three libraries": rural collective land ownership database, rural collective construction land use right database, The database of rural collective land contractual management right is analyzed from the aspects of purpose, mathematical basis, database content and title investigation. (2) combine land ownership with land use, etc. The land types of rural collective land are divided into three parts: the right to use construction land, the right to use agricultural land, the plot of land type, and the meaning of each part. It lays a theoretical foundation for the spatial data organization of the "three bases". (3) based on the existing rural collective land database, the organization and management of the spatial data of the "three databases" are designed, and the attribute structure of each layer is designed. Make the "three libraries" graphics and attributes in one; At the same time, in order to realize the purpose of confirming the right of land, the subject of the right in the process of confirming the right of the land is summarized and its information table is designed, which connects the land with the subject of the right. This is also the practical need of "three libraries". (4) using the personal database function of Arc GIS software, combining the project data of Yuyang District of Yulin City, the spatial data of the database is integrated, and the query of graphic attribute information is realized. (5) the application of "three bases" in the unified registration of real estate, the registration and issuance of land confirmation rights, the delineation of basic farmland, and the work of land survey and demarcation are analyzed. The realization of "three storehouses" can organize and manage all kinds of land and houses in rural collectives in a unified way, and avoid the phenomenon of aggravation of rural contradictions caused by unclear boundary of ownership of land in the course of land circulation. It has the ability to protect the farmers' collective and farmers' land property rights from infringement, and to provide data support for the registration of rural real estate.
