越南河内城市拆迁补偿中的政府责任研究

【摘要】：近几年来，经济持续发展，城市化进程不断加快。科学合理的城市房屋拆迁是完善基础设施建设、提高居民生活质量、提高土地利用率、增强国民经济实力的重大举措。但是也要看到，城市房屋拆迁工作是一项政策性、群众性、经济性都很强，复杂而又艰难的工作。城市房屋拆迁是关系到城市建设与发展，关系到保护群众利益、维护社会稳定、推进城市化进程、拉动区域经济发展的重大现实问题。城市房屋拆迁、安置工作的成败直接影响国家城市规划战略的推进，也是社会、民心稳定的重要因素。城市房屋拆迁、安置已经成为政府和社会共同关注的焦点问题，而城市拆迁补偿问题更是民众所关注的热点。越南城市拆迁补偿制度从开始到不断的完善，体现出了越南政府在改革的过程中政策的执行和调整力度的不断加大。从近些年越南国内拆迁的情况来看，暴力拆迁、强行拆迁等现象时有发生，而这在很大程度在折射出了越南政府与民众利益博奕的紧张关系。越南政府出台和不断调整的征地赔偿制度，，目的在政府与民众利益矛盾当中寻求平衡点，而这些政策的执行和调整对于越南城市房屋拆迁来说也是一个不断进步的过程。本文首先从城市化发展的角度来探究拆迁对于城市化进程的影响力，从国内外学者的研究动态来分析越南城市化过程中，拆迁所体现出来的阻碍力，及城市化所急需解决的诸如拆迁矛盾，对城市拆迁理论、城市拆迁的概念和性质、公共利益和政府补偿责任进行了梳理。重点对政府行为责任的理论分析。如城市拆迁中的政府工具，包括城市拆迁中政府工具的分类界定，政府工具选择的影响因素等方面的研究。本文对越南河内城市房屋拆迁补偿中政府职能行使现状和存在的问题进行了研究，主要分析了越南城市拆迁补偿相关法律制度的发展沿革，从越南的土地政策、征地拆迁补偿制度等角度进行分析。在此基础上研究越南河内城市房屋拆迁的现状，着重从河内拆迁补偿方式和标准和河内房屋拆迁评估几个方面来分析。而对于河内城市房屋拆迁补偿中政府责任行使现状的研究，本文主要从政府宏观、市场、社会三个角度来阐述。本文研究了南宁城市房屋拆迁补偿的经验，以南宁市兴宁区历史文化街区房屋拆迁补为案例，以此作为河内拆迁补偿的经验启示。本文探讨越南河内城市房屋拆迁补偿制度的完善措施，主要从城市房屋拆迁补偿中政府职能定位、城市房屋拆迁补偿中政府市场监管职能定位以及城市房屋拆迁补偿中政府社会管理职能定位。
[Abstract]:In recent years, the sustained development of economy and the acceleration of urbanization. Scientific and reasonable demolition of urban housing is to improve the infrastructure construction, improve the quality of life of the residents, and improve the utilization of land. But we should also see that urban housing demolition and relocation is a policy, mass, economic, complex and difficult work. Urban housing demolition is related to urban construction and development. Related to the protection of the interests of the masses, maintaining social stability, promoting the process of urbanization, stimulating regional economic development, the major practical problems. The success or failure of urban housing demolition and resettlement directly affects the promotion of national urban planning strategy, and is also a society. Urban housing demolition and resettlement have become the focus of common concern of the government and society. However, the issue of compensation for urban demolition is a hot topic of public concern. The compensation system for urban demolition in Vietnam has been continuously improved from the beginning to the end. This reflects the increasing implementation and adjustment of policies by the Vietnamese government in the process of reform. From the situation of domestic demolition in Vietnam in recent years, violent demolition, forced demolition and other phenomena occur from time to time. To a large extent, this reflects the tense relationship between the Vietnamese government and the public interests. The Vietnamese government has introduced and constantly adjusted the land requisition compensation system in order to find a balance between the government and the public's interests. The implementation and adjustment of these policies is also a progressive process for urban housing demolition in Vietnam. This paper first explores the influence of demolition on the process of urbanization from the perspective of urbanization development, and analyzes the hindrance of demolition in the process of urbanization in Vietnam from the research trends of scholars at home and abroad. For example, the contradiction of demolition, the theory of urban demolition, the concept and nature of urban demolition, Public interest and government compensation responsibility are combed. The theoretical analysis of government behavior responsibility is emphasized. For example, government tools in urban demolition, including the classification and definition of government tools in urban demolition. Research on the factors influencing the choice of government tools. This paper studies the status quo and existing problems of government function in urban housing demolition compensation in Hanoi, Vietnam, mainly analyzes the development and evolution of the relevant legal system of urban demolition compensation in Vietnam, and analyzes the land policy of Vietnam. Based on the analysis of compensation system for land expropriation and removal, the present situation of urban house demolition in Hanoi, Vietnam, is studied. Focusing on Hanoi demolition compensation methods and standards and Hanoi housing demolition evaluation several aspects. And for Hanoi urban housing demolition compensation in the status quo of government responsibility, this paper mainly from the government macro, market, Social three angles to elaborate. This paper studies the experience of housing demolition compensation in Nanning city, taking the housing demolition and compensation of historical and cultural blocks in Xingning District of Nanning City as a case, as the inspiration of Hanoi relocation compensation experience. This paper discusses the perfect measures of the compensation system of urban house demolition in Hanoi, Vietnam, mainly from the position of government function in the compensation of urban house demolition. The function of government market supervision in urban house demolition compensation and the function of government social management in urban house demolition compensation.
