莫塞与日本近代地方自治制度的创建

【摘要】：明治维新后,日本在近代国家建设上全面学习西方,为此而聘请了许多外国顾问,德国学者莫塞便是其中最重要的人物之一。莫塞继承了其师德国著名宪法和行政法学者格奈斯特的衣钵,作为日本内阁及内务省的法律顾问,莫塞坚决主张日本在发布宪法、开设国会前实行地方自治制度,并极力将地方名望家族统治理念引入日本,由此在推动日本实现了地方制度近代化的同时,也留下了西方近代法制与日本现实融合的课题。
[Abstract]:After the Meiji Restoration, Japan learned from the West comprehensively in the construction of modern countries. For this reason, many foreign consultants were hired, and the German scholar Mercer was one of the most important figures.As a legal adviser to the Japanese Cabinet and the Ministry of the Interior, Morse insisted that Japan adopt a system of local autonomy before issuing a constitution and opening a parliament.The idea of local famous family rule was introduced into Japan, which not only promoted the modernization of local system in Japan, but also left the subject of the fusion of western modern legal system and Japanese reality.
