瑞士多民族国家治理的制度机制研究

【摘要】:瑞士联邦是以文化多样性为基础建立的国家,它对于文化多样性的尊重和承认贯穿于宪政精神与制度安排始终。首先,瑞士在多民族治理上取得的成功离不开"多元基础上的统一、统一促进多元"的宪政精神,在这样的宪法框架之内,瑞士联邦的各民族才得以和谐的共存。其次,联邦主义在瑞士的民族制度中扮演核心角色,一方面联邦制下的地方共同体保持了它们已有的文化认同与体制独立性,另一方面从尊重承认不同文化的平等价值基础上发展出来包容的新传统,并成为一种基本价值,为所有瑞士人所尊崇,融入国家制度的设计之中,具有了团结与凝聚的效力。再次,瑞士多民族国家的稳定也得益于政党之间的广泛共识和充分合作。
[Abstract]:The Swiss Confederation is a country founded on the basis of cultural diversity, and its respect for and recognition of cultural diversity runs through the spirit of constitutionalism and institutional arrangements. First of all, the success of multi-ethnic governance in Switzerland can not be separated from the constitutional spirit of "unity on the basis of pluralism and unity and promotion of pluralism". Within such a constitutional framework, all nationalities of the Swiss Confederation can coexist harmoniously. Second, federalism plays a central role in the Swiss national system. On the one hand, the local communities under the federal system maintain their existing cultural identity and institutional independence. On the other hand, a new tradition of tolerance was developed on the basis of respecting and recognizing the equal values of different cultures, and became a basic value which was respected by all Swiss and integrated into the design of national system, and had the effect of unity and cohesion. Third, the stability of Switzerland's multi-ethnic state also benefits from broad consensus and full cooperation among political parties.
