论群众路线在法治建设中的运用

【摘要】：群众路线是以毛泽东为代表的先进中国共产党人,运用马克思主义关于人民群众是社会历史创造者的唯物主义原理同中国实际相结合的产物。在新民主主义革命、社会主义建设和改革开放等重要时期,它是指导我们不断取得胜利的法宝。在2014年11月,中国共产党召开了以“依法治国”为主题的十八届四中全会,这在社会主义法治建设上具有里程碑意义。法治作为现代国家的治理方式,在法治建设中运用群众路线,这对社会主义国家现代化建设具有重要的意义。从马克思主义理论中国化、社会主义建设和群众路线理论自身发展来看,在法治建设中运用群众路线是十分必要的,并且从历史经验和现实条件分析,在法治建设中运用群众路线也是可行的。但是我们仍应清楚的认识到,在群众路线与法治建设之间仍然存在诸如理论、实践、评价等问题需要我们去攻克。一方面,在理论上必须理清群众路线与法治建设的内在逻辑关联。首先群众路线体现了人民当家做主的法治本质要求,其次它契合了保障权利的法治价值取向,再次它为培养法治人才提供了重要途径,最后它贯穿于法治建设全过程,保障法治的顺利建设。另一方面,在实践上要解决群众路线在法治建设中具体的应用问题。群众路线推动科学立法、推进依法行政、有助提高司法公信力、增强全民法治观念。群众路线在法治建设的四个环节中都起到到了群策群力的作用。总结群众路线在法治建设中理论和实践上的运用,可以看出群众路线的运用对于法治建设具有十分重要意义。在法治建设中运用群众路线是巩固党的领导的重要保证,是健全人民民主的根本要求,是全面依法治国的正确路径,还是实现社会主义法治的内在支撑。
[Abstract]:The mass line is an advanced Chinese Communists represented by Mao Zedong, using the materialist principle of Marx doctrine that the masses are the creators of social history and the Chinese reality. In the new democratic revolution, socialist construction and reform and opening up, it is the way to guide us to win the victory. In November 2014, the Communist Party of China held a the fourth Plenary Session of the 18th CPC Central Committee theme of "governing the country by law", which was a landmark in the construction of the socialist rule of law. As a modern state of governance, the rule of law used the mass line in the construction of the rule of law, which was of great significance to the modernization of the socially righteous state. It is necessary to use the mass line in the construction of the rule of law, and it is necessary to use the mass line in the construction of the rule of law. It is also feasible to use the mass line in the construction of the rule of law in the construction of the rule of law. However, we should still understand clearly that the mass line and the rule of law should be realized in the construction of the rule of law. There still exist such problems as theory, practice and evaluation. On the one hand, we must clarify the inner logical connection between the mass line and the construction of the rule of law in theory. First, the mass line embodies the essential requirement of the rule of law of the people, and then it fits the value orientation of the rule of law for the rights of security. In the end it runs through the whole process of building the rule of law and ensures the smooth construction of the rule of law. On the other hand, in practice, we should solve the concrete application problems of the mass line in the construction of the rule of law. The mass line promotes scientific legislation and promotes the Administration by law. It will help to improve the judicial credibility and strengthen the concept of the rule of law for the whole people. The public line has played an important role in the four links of the construction of the rule of law. To sum up the theory and practice of the mass line in the construction of the rule of law, we can see that the use of the mass line is of great significance to the construction of the rule of law. The fundamental requirement of the whole people's democracy is the correct path to comprehensively manage the country according to law, or the inherent support for realizing the socialist rule of law.
