清末民族国家建设与赵尔丰在康区的法制改革

【摘要】：1905—1911年间,赵尔丰以西方民族国家观念为基础,在康区实施了一系列的法制改革:剥夺土司头人、寺院活佛等的司法权力,废除当地传统的法律惯习,要求所有民刑案件都由新设立的政府机构依照《大清律例》处理,司法制度与内地保持一致等。强调统一的国族认同、一体化的政治法律制度。法律一体化改革带有鲜明的模仿、移植色彩。从1930年代苏法成等人在康区进行的司法现状调查看,赵尔丰法制改革的社会影响在短暂的高潮之后迅即衰微,说明赵尔丰的法制改革虽然符合当时中国的国家利益和时代发展的潮流,但尚未找到适合中国国情、充分兼顾各地方各民族文化传统的现代法制建设道路。

From the investigation of the current situation of justice carried out by Su Facheng and others in Kang District in the 1930s, The social impact of Zhao Erfeng's legal system reform declined immediately after a brief climax, indicating that although Zhao Erfeng's legal system reform was in line with China's national interests at that time and the trend of development of the times, it had not yet been found suitable for China's national conditions.
