苏轼对宋代“海上丝路”贸易法规建设的贡献——以苏轼有关高丽的状文为例

【摘要】：宋朝的"元丰市舶条"是中国历史上第一部对外贸易法规。主政杭州和礼部的苏轼,在自己的状文中详细记录了这部法规的修改完善过程,并结合自己施政实践,对该法规的形成和完善有所贡献。苏轼在推进对外贸易立法过程中尽管也体现了华夷有别、正朔有分的封建思想,但认为对外贸易需要服从国家安全、要有法可依、要贯彻公平原则、要体现务实双赢、要以人民的福祉利益为重、要坚持可持续发展等理念,在今天仍有现实意义。
[Abstract]:The Song Dynasty's "Yuanfeng Shibojiao" is the first foreign trade law in Chinese history. Su Shi, who is in charge of Hangzhou and the Ministry of Rites, has recorded in detail the process of revision and perfection of this law in his own text, and has combined his own administrative practice. Su Shi made some contributions to the formation and perfection of the law. Although Su Shi also embodied the feudal ideology of "Hua Yi" and "Zheng Shuo" in the process of promoting foreign trade legislation, he believed that foreign trade needed to be served by national security, and that there should be laws to follow. To implement the principle of fairness, to embody the pragmatic win-win situation, to focus on the welfare of the people, and to adhere to the concept of sustainable development are still of practical significance today.
