群体性事件处置法律机制研究

【摘要】：随着群体性事件现象的逐渐增多，群体性事件已经涉及到政治、经济等等社会诸多方面。法社会学更加注重通过法律对社会加深认知，同时又在社会运行过程中解释法律，，这种兼容并蓄的研究方式，无疑为法学理论的研究开拓了空间，也为分析群体性事件的概念、发生原因、社会影响等问题增添了新的研究视角,运用法社会学理论研究群体性事件处置法律机制的完善问题，会最终提高法社会学解决实际社会问题的能力。本文第一章首先，通过文献分析法，利用社会冲突理论理解群体性事件，明确群体性事件的法学概念，了解群体性事件必须具备的基本特征，以期对后面将探讨的群体性事件处置问题进行理论上的准备。其次，主要围绕当今群体性事件产生的社会影响和对其处置的必要性展开，从法社会学角度分析社会与群体性事件之间的关系。具体内容包括群体性事件对社会的正面影响和负面影响，而后通过分析社会冲突理论得出群体性事件长期存在的可能性的结论，并提出其处置的必要性问题。本文第二章采用文本分析法和实证分析法，分析国内处置群体性事件现状和缺陷，通过分析法律文本，明确国内处置群体性事件现状，分析法律文本规定的具体内容，总结我国立法和执法上的缺陷；举例比较分析近年国内个别典型群体性事件，利用典型案例分析，以期对国内群体性事件获得更加充分的认识，意识到其特殊性。本文第三章第一个内容主要探讨在应对群体性事件过程中应当坚持的基本原则，明确相关部门行动宗旨和标准，宏观把握应对群体性事件的方针政策；第二个内容是针对群体性事件事前、事中、事后阶段应该形成的具体处置机制，例如应急预案机制、现场应对机制、善后处理机制。本文第四章探讨我国群体性事件处置法律机制的具体法律应对策略，是作为综合治理的一部分的法律层面的相关对策，从完善立法、依法行政、公正司法、提高法治意识等四个角度提出具体建议。
[Abstract]:With the gradual increase of group events, group events have been related to the political, economic and social aspects. Pay more attention to deepen the cognition of the social law through legal society, and the interpretation of the law in the social operation process, this study undoubtedly opens up the fully inclusive and equitable, space for the research of legal theories, also occurred the reason for the concept, analysis of group events, social impact and add a new research perspective, improve the problem by using the method of sociological theory of group events disposal legal mechanism, will ultimately improve the learning ability of solving practical social problems of the law society.
The first chapter of this thesis, through literature analysis, understanding of group events using the theory of social conflict, a clear legal concept of group events, to understand the basic characteristics of group events must have, make theoretical preparation to explore on the back of the mass incidents. Secondly, mainly focus on the social impact of the group the necessity and the disposal of the expansion, from the sociological perspective of the relationship between law and social group events. The specific contents include positive and negative effects of group events on the social effects, and the possibility by analyzing the theory of social conflict that group events exist for a long time the conclusion, and puts forward the disposal the necessity of the problem. The second chapter uses the text analysis and empirical analysis, analysis of the status quo and defects in dealing with group events, through the analysis of legal texts, Specify the disposal status of mass incidents, the content analysis of specific provisions of legal texts, summarizes the defects of China's legislation and law enforcement; for example, comparative analysis of typical mass incidents in recent years, the typical case analysis, in order to obtain a more fully understanding of domestic group events, aware of its particularity. In the third chapter the first main research contents should adhere to the basic principles in dealing with group events, the relevant departments clear purpose and action standard, grasp the macro group events policies; the second content is for group events in advance, in the matter, the specific disposal mechanism of later stages should be formed, such as emergency response, site the response mechanism, dealing with the aftermath of the specific legal countermeasures mechanism. The fourth chapter probes into the disposal of mass incidents in China legal system, is as comprehensive treatment A part of the legal level of the relevant countermeasures, from the perfection of legislation, the administration according to law, fair judicature, and improve the consciousness of the rule of law, and so on four points of view to put forward specific suggestions.
