【摘要】： 公安机关行政执法公信力是公安机关信用体系的基石和核心,也是建设和谐警民关系的基本要素。现实中,影响公安机关行政执法公信力的主要原因有：不作为与滥作为。不作为根据其主观意思表示又可分为真正的不作为和不敢作为,它们的产生有着不同的原因。真正的不作为指其本身有执行职务的义务与能力,而主观上有不履行的故意,客观上没有履行其职务的行为发生。而不敢作为指其主观上积极愿意作为,并且有履行职责的义务,但因为外在的客观条件使其履行义务时有更大的危险,或履行职责后缺乏保障,而不履行职责的行为。滥作为主要是指公安机关在日常执法中从事的非警务活动,这些非警务活动中既有群众反对的,也有群众拥护的,非警务活动占用了警力,弱化了公安机关打击犯罪的职能。此外,舆论导向的不全面也对公安机关行政执法公信力带来一定的负面影响。所以要想提高公安机关行政执法公信力那么就必须加大对公安机关的执法保障,提高广大民警的执法热情,敢于执法。这样才能有效地打击违法犯罪,维护社会治安秩序,提高人民群众的安全感,使公安工作得到认可,从而提高公安机关的行政执法公信力。同时不应扩大公安机关的行政职权。公安机关的身影应多出现在打击犯罪中,而不是拆迁现场和各种开道车队中。唯有严格执法,决不允许任何违法犯罪分子逍遥法外,更不允许任何不作为、滥作为行为对群众造成伤害,切实规范舆论引导,加大正面宣传,取得广大人民群众的信任支持,才能提高公安机关的行政执法公信力。
[Abstract]:The public security organ administrative law enforcement credibility is the public security organ credit system foundation stone and the core, also is the basic factor which constructs the harmonious police community relations. The main reasons that affect the credibility of public security organs' administrative law enforcement are: omission and overaction. According to their subjective intention, omission can be divided into real omission and dare not to act. They come into being for different reasons. Real omission refers to their own duty and ability to perform their duties, while subjectively there is intention to fail to perform. Objectively, the act of failing to perform its duties occurs. But it does not dare to act subjectively and actively, and has the obligation to perform its duties, but the external objective conditions make it more dangerous to perform its duties. Or the lack of protection after performing their duties and not performing their duties. Abuse mainly refers to the public security organs in the daily law enforcement activities engaged in non-police activities, these non-police activities have been opposed by the masses. There is also popular support that non-police activities occupy the police force and weaken the role of the public security organs in cracking down on crime. The incomplete guidance of public opinion also has a certain negative impact on the public security organs' credibility of administrative law enforcement. So if we want to improve the public security organs' public security organs' credibility of administrative law enforcement, we must strengthen the protection of public security organs' law enforcement. Only in this way can we effectively crack down on illegal crimes, maintain public order, improve the people's sense of security, and make public security work acceptable. In order to improve the public security organs of the credibility of administrative law enforcement. It is not the demolition of the scene and all kinds of motorcades. Only strict enforcement of the law will not allow any criminal or criminal elements to go unpunished, let alone any omission, and indiscriminate acts will cause harm to the masses. Only by standardizing the guidance of public opinion, increasing the positive propaganda, and gaining the trust and support of the broad masses of the people, can the public security organs enhance the credibility of administrative law enforcement.
