【摘要】：在推进法治建设的大背景下,我国进行社区矫正的试点和全面推行工作,是完善刑事司法制度,推进国家司法文明的一项重要举措。衡阳市雁峰区的社区矫正工作基本能适应实际需要,该区在实践工作中,总结出了许多便于工作的经验。但同时也存在不少问题,如社区矫正立法不完备、执法主体与工作主体资格分离、相关主体协作不够、矫正管理机制不健全以及矫正工作队伍专业化程度不高等制约着社区矫正工作的发展。针对这些问题,应从完善社区矫正立法、完善社区矫正管理工作机制、加强执法队伍建设、加强与相关主体的联动机制建设、充分调动利用其他社会资源等方面推进社区矫正工作的法制化和制度化建设。社区矫正的理论问题还需要更深层次的研究和探索。我国的社区矫正工作还处于起步阶段,寻找工作的弱点、难点、重点,借鉴国外先进的社区矫正工作经验,对完善社区矫正法制化建设具有重要意义。
[Abstract]:In the background of promoting the construction of the rule of law, China's community correction pilot and full implementation of the work is to improve the criminal justice system, an important initiative to promote the national judicial civilization. Hengyang Yanfeng district community correction work can basically meet the actual needs of the region, in practical work, summed up a lot of convenience work experience. But there are also many problems, such as community correction legislation is not perfect, law enforcement qualification and the main work of the main separation, related to the subject of collaboration is not enough, the professional course correction management mechanism is not sound and the correction work team of restricting the development of community correction work. To solve these problems, we should perfect the legislation of community correction. Perfect community correction management mechanism, strengthening of law enforcement, strengthen the construction of linkage mechanism and related bodies, fully mobilize the use of other social resources and promote community The construction of legal system and institutional corrections. Theoretical issues of community correction also need to study and deeper exploration. Community correction in our country is still in its infancy, looking for work weakness, difficulty, focus, learn from foreign advanced experience of community correction work, has important significance for the improvement of the legal construction of community correction.
