工程建设领域职务犯罪的防治研究

【摘要】：在工程建设领域中,施工、建设、中介、管理等环节与工程相关的各个部门的管理人员,很容易发生利用手中职权来谋取一己之私从而破坏社会次序,引起巨大经济损失,此类行为触犯法律理应处以刑罚,被称之为工程建设领域职务犯罪。①作者首先分析了工程建设领域职务犯罪的内涵、类型、特点、发生环节和社会危害,然后针对工程建设领域的特点,从工程建设领域存在较大的利润空间、部分领导法治观念淡薄、工程建设领域的不正当竞争日益激烈、工程建设领域的监管不到位和对工程建设领域的犯罪打击乏力等五个方面分析工程建设领域职务犯罪的原因。接下来,介绍工程建设领域职务犯罪的国际经验,在分析美国职务犯罪防治的机制与经验的基础上,进一步探讨两种有助于遏制工程建设腐败的管理技术。最后,研究寻找工程建设领域职务犯罪问题的预防及对策,探讨改革模式。笔者从职务犯罪的职务性防治和工程建设领域职务犯罪的技术性防治两个角度讨论在实际情况中可实行的方案措施。在生产建筑产品的过程中我们可以得知,建筑产业包括项目规划及审批、发承包、中介服务、施工验收等部分,它们环环相扣,前后制约,一环出错则后果严重。因此,建筑工程按生产过程根据工作内容的不同可以被分成若干部分进行针对性的研究,剖析每个部分各自的特殊成因,在法律、机制的前提下提出方针策略,运用一切可能会涉及到的社会各个方面的具体方法,完善工程建设领域职务犯罪预防政策制度。
[Abstract]:In the field of construction, construction, construction, intermediary, management and other links related to the various departments of management, it is easy to take advantage of their power to seek personal gains, thus undermining the social order, causing huge economic losses. The author first analyzes the connotation, types, characteristics, links and social harm of the job-related crimes in the field of engineering construction. Then in view of the characteristics of the engineering construction field, there is a large profit space in the engineering construction field, some leaders have a weak sense of the rule of law, and the unfair competition in the engineering construction field is becoming increasingly fierce. This paper analyzes the causes of job-related crime in engineering construction from five aspects, such as inadequate supervision in the field of engineering construction and weak crackdown on crime in the field of engineering construction. Next, it introduces the international experience of duty crime in the field of engineering construction. Based on the analysis of the mechanism and experience of the prevention and control of job-related crimes in the United States, this paper further discusses two kinds of management techniques which are helpful to curb corruption in engineering construction. Finally, the paper studies the prevention and countermeasures of the problem of job-related crimes in the field of engineering construction. This paper discusses the reform mode. The author discusses the scheme measures that can be carried out in the actual situation from the two angles of duty crime prevention and technical prevention and control in the field of engineering construction. In the process of producing construction products, we can know that, The construction industry includes the parts of project planning and examination and approval, contracting, intermediary services, construction acceptance and so on. They are intertwined, restricted before and after, and if one link goes wrong, the consequences are serious. According to the production process, the construction engineering can be divided into several parts according to the different contents of the work to carry out targeted research, analyze the special causes of each part, and put forward the policy strategy under the premise of law and mechanism. To perfect the policy system of duty crime prevention in the field of engineering construction by using all the concrete methods of all aspects of society that may be involved.
