群体性事件的运作机制及其法律应对

【摘要】：改革开放以来,我国经济得到长足发展,人们生活水平大幅提高。但群体性事件在各地区、各领域却频发,给社会的稳定带来了巨大的挑战。政府投入大量的人力、物力及财力应对群体性事件,但目前仍陷于治标不治本的困境。本文正是立足于我国社会转型时期这一大背景下,对群体性事件的运作机制及其法律应对策略进行探析。笔者在现有研究文献的基础上对群体性事件概念的变迁、界定以及类型归纳进行了阐释。在厘定基本概念后选择瓮安事件这个典型案例,通过结构性因素、群体认同感、刺激性因素及群体性心理这四个层次对瓮安事件的发生和发展过程进行了梳理,并论证了这四个因素对事件运作机制的影响。在此基础上通过从转型时期的社会及公民、现行法律制度、传统社会治理方式这三个视域对群体性事件的社会动因进行探析,最后着重从转变固有观念、畅通利益表达机制、完善责任追究制度以及健全司法救济制度四个方面建言献计。总之,群体性事件的发生是社会转型期不同利益群体冲突的结果,是相关群体利益表达和利益诉求的一种形式。社会的长治久安,需要在法域空间内正确地认识和处理群体性事件。
[Abstract]:Since the reform and opening up, the economy of our country has been greatly developed, and the living standard of people has been greatly improved. However, mass incidents occur frequently in various regions and fields, which bring great challenges to the stability of the society. The government has put a lot of manpower into it. Material resources and financial resources deal with group events, but at present they are still in the dilemma of treating symptoms rather than the root causes. This article is based on the background of the period of social transformation in our country, and analyzes the operation mechanism and legal countermeasures of group incidents. On the basis of the existing research literature, the author explains the change, definition and type induction of the concept of group event. After defining the basic concept, the author chooses Weng'an event as a typical case, through structural factors, group identity. The four levels of stimulative factors and group psychology have combed the occurrence and development process of Weng'an incident, and demonstrated the influence of these four factors on the operation mechanism of the incident. The current legal system and the traditional social governance mode are the three perspectives to analyze the social motivation of group events. Finally, the emphasis is placed on changing the inherent concept and unblocking the mechanism of interest expression. Perfect responsibility investigation system and perfect judicial relief system four aspects of suggestions. In short, the occurrence of group events is the result of the conflict of different interest groups in the period of social transformation, and is a form of expression and interest appeal of related groups. It is necessary to correctly recognize and deal with group events in the space of jurisdiction.
