临泉县毒品犯罪实证分析

【摘要】： 毒品犯罪已成为全球性的难题,世界各国都对其作了艰苦而持久的斗争,而毒品犯罪并未就此消亡,反而有愈演愈烈之势。安徽省西北边陲的国家级贫困县,全国第一人口大县——临泉县,周边分别与河南、安徽两省的九个县(市、区)接壤,这一独特的地理环境,加以种种复杂的原因,绝迹三十余年的毒品犯罪在80年代死灰复燃,且迅速蔓延,个别乡镇尤为猖獗,已经形成了地下毒品消费市场和集散地,成为其他多种犯罪的诱发源。本文通过对临泉县32个乡镇毒品犯罪情况进行调查,从临泉县公安局、人民法院调出大量详实的案例,结合近年来我国经济体系改革、经济发展现状,密切关注毒品发展的规律,以犯罪学为基础,借鉴运用了社会学、心理学、行为学、哲学的科学方法,深入系统分析了临泉县毒品犯罪这一特定区域的个体的和社会的等原因。过去我们对临泉县这一特定区域的毒品犯罪从总体上重视不够,虽然在打击处理预防方面取得了一定成效,但对临泉县毒品犯罪缺乏深入的、系统的、专业的思考和研究,即使有也是对某一个个案进行剖析,不少人认为,毒品犯罪在刑事犯罪中的比重不大,不值得深入研究,本文认为,这是一个很大的误区。毒品犯罪已经对临泉县这一特定区域的经济发展、社会稳定和群众的身体健康造成了严重的危害。文章主要介绍了临泉县毒品犯罪的基本情况和毒品犯罪的打击处理情况。近年来,临泉县毒情形势呈现出案件增多,外流犯罪活动突出,贩运路线错综、涉及地区复杂,团伙趋于有组织化,作案手段诡秘,藏毒方式多样,涉毒区域扩大,“汽球”效应明显等特点。分析了毒品犯罪产生问题的原因,如毒品高额利润的驱使,对毒品犯罪的严重危害性认识不足等。着重评析临泉县公安局侦破“2008.9.26”公安部毒品目标案件和办理本案的成功经验。在金融危机下临泉县毒品违法犯罪新形势做了一定的评析。由于受国际毒潮和国内毒品犯罪大气候的影响,临泉县已由过去的种植罂粟为主,发展为外流贩毒与消费并存的县,毒情趋向严重。在金融危机下,政治、经济和社会领域已发生重大而深远的变化,对临泉县的禁毒工作也将产生深远的影响。禁毒工作的不利因素在一定时期内可能会增多。笔者试对金融危机下全县毒品违法犯罪发展趋势作一些分析,掌握禁毒工作的主动权。最后,介绍了我对毒品犯罪的综合整治的一些看法。拟从情报信息的角度,运用信息论、系统论之认识工具,就如何充分发挥情报信息在缉毒侦查工作中的作用发表粗浅的看法。从广义角度,缉毒工作可归于刑事侦查范畴。从公安工作的职能划分角度,缉毒工作因其侦查客体、侦查手段等方面的特殊性而有别于刑侦、经侦和国内安全保卫。侦查全程的信息化,是缉毒工作在当前实践中反映的主要特征。我国《禁毒法》确定“预防为主,综合治理,禁吸、禁贩、禁种、禁制并举”的禁毒方针,坚持控制非法供应和防止滥用并重,禁止和打击一切从事毒品违法犯罪活动。注重禁毒的综合治理,《中华人民共和国禁毒法》规定“禁毒工作实行政府统一领导、有关部门各负其职,社会广泛参与的工作机制”,也是一项系统工程,专门工作与群众路线相结合,各职能部门协调配合,实行综合治理。临泉县要按照《临泉县禁毒工作领导责任制追究暂行办法》坚决奖惩到位,严格落实责任追究制度。

This paper mainly introduces the basic situation of combating drug crimes and drug crimes in the county.
