我国少年犯罪处置制度研究

【摘要】：少年犯罪问题一直是困扰世界各国的难题,我国也不例外,而随着我国经济社会的发展,少年犯罪问题也日益突出,少年犯罪呈现出高发化、低龄化、团伙化、规模化、智能化及涉案种类多元化等特点,突出了少年犯罪的严峻形势。而少年犯罪与成年人犯罪二者的区别除了在由于辨认和控制能力的区别导致的刑法中所定义的犯罪行为之外,更重要的一个区别在于,我们在研究少年犯罪的过程中同时会关注到少年的偏差行为,笔者将其定义为危害社会但达不到刑法中对犯罪概念的行为。因此由于少年犯罪的范围以及含义与成年人犯罪不同,而基于此种不同,对于少年犯罪的处置当然需要独立于成年人犯罪。构建起独立的、符合少年犯罪概念的,多元化责任承担方式的这样一种处置体系。而基于少年成长的特点,以及国际社会中对于少年犯处置上达成的共识性的原则,在面对涉罪少年之时,更应当将少年犯罪的处置从消极的事后惩罚转变为积极的事先预防,对涉罪少年更应该秉持“教育为主、惩罚为辅”、“教育、感化、挽救”原则,让涉罪少年在今后的生活中逐渐成为可以适应社会并融入社会生活,而非是一味的对其行为进行法律上的谴责,过于强调刑罚的惩罚性。在处理少年犯罪的过程中,不仅仅是法学一门学科就可以解决的问题,少年犯罪是需要全社会的共同关注,在构建少年犯罪独立的处置制度时,就需要我们充分考虑到建立多元化的责任承担方式,笔者建议以非刑罚处置措施为主,刑罚处置为辅的处置制度。这样既可以最大程度的消除“标签效应”和交叉感染等刑罚措施的负面影响,让涉罪少年早日融入社会正常生活,并减少其再犯的可能性。又能够对涉罪少年的犯罪行为及时得到矫正,让其意识到行为的后果及错误,同时也能更好的弥补受到损害的社会关系。
[Abstract]:The problem of juvenile delinquency has always been a difficult problem for all countries in the world, and China is no exception. With the development of our country's economy and society, the problem of juvenile delinquency has become increasingly prominent. Juvenile delinquency has shown a high incidence, a low age, a gang and a large scale. The characteristics of intelligence and diversified types of cases highlight the severe situation of juvenile delinquency, and the difference between juvenile delinquency and adult delinquency is in addition to the criminal acts defined in the criminal law due to the difference in identification and control ability. A more important difference is that in the process of studying juvenile delinquency, we also pay attention to juvenile deviant behavior. The author defines it as an act that endangers society but does not reach the concept of crime in criminal law. Therefore, because the scope and meaning of juvenile delinquency is different from that of adult crime, it is based on this difference. To deal with juvenile delinquency, of course, we need to be independent of adult delinquency. We should set up such a system of dealing with juvenile delinquency independently, in line with the concept of juvenile delinquency and in a variety of ways of taking responsibility. And based on the characteristics of juvenile growth, As well as the principle of consensus in the international community on the treatment of juvenile offenders, in the face of delinquent juveniles, it is even more appropriate to change the treatment of juvenile delinquency from passive afterwards punishment to positive pre-emptive prevention, We should also uphold the principle of "education first, punishment secondary" and "education, probation and rescue" so that they can gradually adapt to society and integrate into social life in the future. In the process of dealing with juvenile delinquency, it is not just a subject of law that can be solved. Juvenile delinquency needs the common attention of the whole society. In the process of constructing an independent system of handling juvenile delinquency, we need to take full account of the establishment of a diversified mode of responsibility, and the author suggests that non-penal measures should be taken into account. The disposal system supplemented by penalty disposal. This can eliminate the negative effects of the "label effect" and cross-infection measures to the maximum extent, so that the delinquent juveniles can be integrated into the normal life of society as soon as possible. And reduce the possibility of recidivism, and can correct the criminal behavior of the delinquent juvenile in time, make them aware of the consequences and mistakes of the behavior, at the same time, can make up for the damaged social relations better.
